          okay, now its very important that this is an honest answer

          if you dont know then say i dont know ok

          Was the PPI policy optional at all? were you advised that you had to take the PPI to get the loan? were you made aware that you had PPI and did the bank carry out any checks to assess if the policy was suitable for you

          also,

          Were either of you self employed at the time you took out the loan?

          did either of you have any pre exsisting medical conditions when you took out the loan?

            To be honest with you I cant be 100% sure, I remember the conversation mostly, NW had rung complaining that I was over my overdraft limit and she was really nasty and told me to get a full time job to be able to meet our payments, in fact she had me in tears then she suggested a new loan to pay off our existing loan and the overdraft, now I really can not remember her telling me anything about PPi, I was not given figures with and without this product.

            Neither of us were self employed at the time.

            Hubby had a pre existing illness (knee replacement in 2003)

            I think I see where you are going with this, sent SAR months ago nothing much regarding PPi, Have an ongoing claim for PPi with NW already.

              thanks for your honesty

              I think that, this case is likely to be extremely difficult as it stands.

              the problem we have, is that, firstly there was an admission filed.

              thus allowing natwest to get a judgment. its going to be almost impossible to set that aside IMHO. so i need to look for a substantial ground to seek permission for a counter-claim

              Have you filed a counter claim for charges? if you have then we have something to latch on to

              I have a meeting with counsel who is very knowledgable in consumer law at the end of next week, i will try and get his opinion on the sly, as to what is the best way to move forward.

              It may be worth looking at the Bar PRo Bono dept as you may need legal representation on this case if we do fight and you go to trial as i would strongly advise being represented as it can make the difference in court.

                    Sorry I just went off line last night, I just got so down about everything and needed a good cry!! I just cant believe what an utter mess I have made of things and how it can not easily be put right! Just wish I had the money to clear this just to get rid of the whole mess but I havent so thats out of the question. I do appreciate everyones help, in fact I dont know what I would have done without you. Just feel like I am in a deep whole and cant get out of it!! I have never felt so stressed out in my life!

                      you havent made a mess of anything honey, you didn't know and natwest are in the wrong not you.

                      Right heres the updated charges spreadsheet...should be okay to open in openoffice but am doing an openoffice version too (don't have openoffice on this puter yet so bear with me whil ei download it)

                            Thank you Amethyst for that, I will have a look at them now.

                            I just feel so down about it, I hate to keep pestering and relying on you as you are very busy and have your own problems I am sure.

                            My hubby is not feeling very good at all, he is at home now but has an infection to top everything!! All adding to the pressure!

                            Oh well I will try and hit NW with the bank charge claim now and step things up a gear or two and see where that gets me - just need a bit of luck my way for a change.

                            Do you think I should get some legal representation? Its just we have no spare money at the min.

                              If I can post this up for you, Im not sure if you qualify or even if its suitable:

                              Legal aid provision is divided in to civil legal aid and criminal legal aid. Each has its own financial eligibility criteria. Both may apply a legal merit test. On the 6th of April 2009, the financial eligibility criteria for civil legal aid was changed. The monthly disposable income limit is now £733, up by £35 from £698 and the capital threshold is £8000. There is a different financial eligibility criteria for criminal legal aid in the Magistrates Court. For more detailed information refer to the Legal Services Commission website here:

                                Also, the Bar pro bono department is Freeeeeeeeeeeee totally, you will get a barrister for free if you are eligible. id advise that you contact them as a matter of urgency and see if you can get some assistence
