    In the letter for Court I dont know which Judge will be present or did you leave a space for something else?

        The mortgage interest only part are you paying 411 or 187 (or is 187 the amount it reduced by when you switched to interest only ?)

        Am just putting your IE in a Beagles form so I can see more clearly where you are at - when i'm done i will email it back to you - do you have open office or excel spreadsheet programmes on your pc ?

            Thats okay will put it in word for you.

            So you are paying 187 for the mortgage interest only.

            Is this seperate from the other two secured debts ? (£200 ish and £600 ish ones)

              Sorry my mistake, we only have the mortgage which we are paying £187 interest only but it should be around £400 and the secured loan for 600ish. This was a old IE sheet which I have amended.

                • It makes quite a big difference to the offers, if you are normally paying £411 and just have a short temp releive to pay £187 a month then I think you should keep with the £411 figure else you will be giong back for redetermination in a couple months.



                  do you have agreements in writing from Cahoot and Egg to pay £10 per month ?

                  If so we can amend these figures but this is proportionally worked out (as it would be for an IVA/DMP)

                  • Sorry just doing some ironing, but back now. All I have is a letter from Brian Carter (EGG) agreeing that we pay £10, but nothing from Cahoot.

                        Update - Letter hand delivered to court today. I have today recvd letter form Shoosmiths with their statement of costs for the forthcoming hearing £192.50 including tax, I assume thats now added to what I owe already?? This is getting out of hand!
                        What am I to expect at the court hearing, what will happen, what do I have to do? Is there anything I need to take with me? Sorry for all the questions but I just want to be prepared.

                              Well I am back! It was no where near as bad as I imagined. I got quite a sympathetic judge and Shoosmiths solicitor was present. Shoosmiths begun by saying they did not know today was for a redetermination, they thought it was for them to apply for a charging order! The Judge looked at my paperwork (Thanks Amethyst!!!) he clarified the situation with myself and was surprised that Natwest were persuing both my hubby and me for the same debt but after checking all the paper work again and although he could see that the amounts were nearly identical there was no mention of the account numbers on my hubbys Judgement to link it to mine which he said was unfortunate. He asked the Shoosmiths solicitor why Natwest were persuing us seperatley and the solicitor said they knew nothing about this until today (which was a lie cause I rang and pointed this out - before I knew better to do everything by letter) but that they were within their rights to do this if they wanted anyway. The judge asked if I was able to pay something each month to which I suggested £20 he put this to Shoosmiths who replied that it would take around 20 years to pay off and they would not be happy with this and that they would still go for a charging order. The judge ruled that I could pay £20 per month from the end of December and would allow Shoosmiths to apply for a charging order but he looked at me and said this does not mean they will get it, the judge also suggested that we looked into having my hubbys judgment voided (my word not his - cant remember how he put it). He also made a note that we were attempting to claim back almost all this amount in charges. HOWEVER, when I got home there was a letter from the court for my hubby!!! Irwin Mitchell (Natwest Solicitors for hubbys claim) have now applied for a "Variation of Judgment Order" - hearing date 9th December !!!! (not much notice) in the application notice form it says that although hubby has kept upto date with payments it would take approx 22yrs to pay off and so want a charging order to secure it!!!!! I just cant believe this, are we to ever have any peace at all? I am looking for help again I am afraid??????

                                So, sort of good news and bad news on the same day. I'm sure someone will be able to suggest a way forward. Don't forget you have the other thread as well, might be better to try and keep it all on the same thread, to save confusion (mainly mine lol)
