    Hiya Ruby,

    Best approach is as Amethyst and Amy have already suggested.

    Please can you fill in the missing bits on the draft Witness statement that Ame posted earlier and send it to her via email to check.

    She / we will work on an accompanying letter to send to the court with the finished witness statement.

    As a side issue can you please tell me a bit more about where you are with regards to reclaiming your charges from Natwest?
    Have you already sent a SAR and received all your statements back?
    How did you calculate the figure that you say they owe you?
    Have you sent them any letters yet asking them to repay the charges?
    Have you had any help, maybe on another site, with this reclaiming process?

      Hi Budgie, I will fill in the Witness statement, I thought Ame was still working on it sorry. With regards to reclaiming charges back, SAR sent, Statements recvd, charges + interest claimed, sent letter claiming hardship and asking for money back, they wrote and asked us to fill in a customer financial statement form and send back with a payslip, which was sent back on the 18/10/2008 now just playing the waiting game.

        Hi I am back at last had problems with computer - great timing!! My redetermination hearing is a week today I have not been able to send in the N244 as I simply do not have £75 fee. Just called the court to ask if I need to take anything with me and the clerk said "thats up to you" (really helpful!!) Can anyone help me what to do, should I still do the Witness Statement or dont I need that now? Please help me!!

          Ruby, in post #51 above I have said that you may well qualify for remission or even exemption from court fees.

          You need to fill out an EX160 and explain why to pay this fee will cause you hardship. You should not not file the AQ just because you cannot afford to. Justice is not there merely for those that can afford it.

              If it were me, I'd fill out and file the N244, but it's up to you and it's not too late to do it if you want to.

                      Message from Ame over the phone as she is busy doing her daughters birthday party and isn`t about much.

                      Yes send in the witness statement ASAP (ie Monday) but first if you could post it up with the details added that Ame asked you to put in previously.

                      Leave the N244 for now.

                      Once you have posted it up with the details added Ame will take a look later this evening.

                        Also I did send in A £1 and asked for copies of loan agreements and someone suggested asking for a signed copy of when the joint account was altered to a Gold account, Natwest have sent copy of loan agreement but can not locate a copy of Gold account, dont know whether that helps at all??

                            Hi ruby so sorry my heads been full of crap this week and I have a bunch of 8/9 yr old decending on me any moment, but i will come on tonight and go through everything. If you can do the WS with your details it will help make sure its right. I think then we need to be guided by the Judge,, there are a couple bits i want to add to the WS too, hopefully we'll negate the need for the N244 but it is likely that the judge will order you apply formally to have the claim struck out, will be back after 7 xxxx

                              re personal stuff put in figures etc but leave off the majority of account numbers and your names and that will be okay
