    Hi Piesky,

    I just went into my branch and asked for the statements. No charge and they arrived about a week later. They did only provide the last 6 years though. Luckily had the previous ones.

    Hi Jax, unfortuantly it is still a business account even though you were T/A and as such you are not a consumer and therefore UTCR ar definatly not applicable.

      Hi Piesky

      I don't think we sent SAR as it's a fairly recent account and we had all the statements (from memory).

      I have attached our Request for Refund letter - which will probably need editing/amending now.

      Perhaps someone will have a look at it and edit it for you.

        Thanks for the letter Jax. How is this claim progressing and what sort of replies are you getting from Nat West regarding the repayment of charges and compensatory interest? - in other words, are they playing ball.

          Piesky please read back on thread and you will see my refusal of offer from Nat West - the charges claim alone is £1848 they originally offered £1332 which I refused (see letter back in thread) and then subsequently offered £1510 (which again does not even meet the charges).

          I have just realized writing this reply to you that I have not sent an LBA and have gone gung-ho into a court claim - I need to address this before shooting off my POC.

          Will come back to you on this point once I have response from the powers-that-be on the site.

              Not sure if you're in the UK at the moment or on holiday?? Have tried calling you.

              Not been on site for a while due to personal issues as I said - have you managed to do anything with my POC on here yet? There was also another member that had a POC for a business account (or wanted one??)

              Sorry - if I sound a bit mad but things are not good at the moment and I'm having a bit of a problem mentally and emotionally.

                    As its a sole trader account as things stand just stick with the standard LBA - LBA should only be a shortened version of your prelim letter, reiterating your request and giving 14 days before you file, and should also enclose an updated spreadsheet as to what you are claiming. As its a trading as account UTCCR should apply although this is debatable but include that and penalty charge arguments as per your prelim. I wouldnt fly into a court claim yet though - do you have a copy of your accounts T&C;s ? Oh also, did they reply to your turning down of the intial offer ?

                        I have just been going through all the paperwork on this claim and as you can see have been trying to get it sorted out since November last year!

                        However, we did get a response from Nat West following our refusal of their offer (the next stage was LBA but I mucked up a bit and jumped straight to POC and then realized my error) - it was dated 20 October and one of the paragraphs says that if they don't hear within 8 weeks they can disregard the claim and treat the matter as closed!!!!!

                        Is this right?? If so, can we resurrect it by starting the claim again?

                        Please advise.

                            They can not dictate the time scale, wouldnt that be convieniant for them, why not give 24 hours or "we consider the matter closed".

                            The complaint is made with a view to court action and I believe you will find that you can re visit it at any time (from when it became apparent that you were a victim of overcharging) and 6 years after that date unless the court states otherwise.

                            Do not give up and do not let them dictate the time scales.

                            Seek legal guidence to check the above, Im sure it is correct.
                            The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

                              Have been rather lax on these claims just lately so need to get the ol' finger out and get moving again.

                                There is quite a lot of activity on the business claim front at the moment.

                                This claim is for son-in-law and in brief

                                TRADING AS / ........ account
                                Claim for £1888 charges (July 2002 - July 2008) - there are probably more now
                                Contractual interest £4059
                                Total claim £5947

                                Nat West have offered £1510 ... end of!

                                Any opinions, suggestions what we should do now in the light of the advice not to take to court. I imagine this would render any LBA ineffective as there is no point in threatening court action if you are not going to go through with it.

                                Is there any likelihood of getting these business claims through in the future, eg after test case?
