    I received a letter today and the little loves at Barclays have informed me they have sold my debt, which they allege is £1k to Lowell Portfolio. It has been bounced around with other DCAs but ultimately always got returned to Barclays - funny that.

    This time though, it would appear that they have actually sold it.

    I filed a claim for the return of the charges amounting to £3.3k in August 2007 and it has been stayed since September 2007.

    Have they issued a default with the CRA`s for the 1K debt?

      It doesn't say. All it says is "We hereby give notice of the assignment of the debt due to us from you in respect of the balance of £1,008.64 outstanding on your Barclays Bank plc account.

      On 22nd August 2008 your account was sold to Lowell Portfolio 1 Ltd.

      Any further communications and payments must therefore be addressed to Lowell Portfolio 1 Ltd
      ."

      Also enclosed was a letter from Lowell Portfolio informing me they had been appointed as authorised collection agents for recovery of the outstanding balance.

        I assume you are writing to Lowells to tell them the account was in dispute prior to being sold to them.

            Did Barclays ever issue a Notice of Default and have you checked the CRA`s for any detrimental info entered against you?

            Reason I ask is that exactly the same thing happened to me with my Yorkshire Bank personal account and since then I have been unable to obtain any further credit, i.e promotional rate credit cards.

            edit: Also to add they entered a claim against against me in court for the debt.

                    Also file reports about B'clays with EVERYONE that will listen as this is clearly against the FSA waiver.

                          I missed that article as I was away then. I must say I've not seen anything in the waiver that specificaly precludes the selling of debts. Has anyone?

                          I've got an FoIA request in with the FSA covering this issue so will be interesting to see what they say. I really think the FSA should have made the consumer more aware of their rights under the waiver - they really went the extra mile to make the banks aware of theirs - without us having to rely on a frickin' press article.

                            The debt is CLEARLY in dispute and as such NO further action of any kind should be taken.
                            While this isn't specifically mentioned in the waiver it is covered by the OFT guidelines

                              Well I am sorry but can you expalin this bit to me then?

                              "Under the FSA waiver, current accounts still run in the normal way - you can still incur unauthorised overdraft charges and the actual account is not frozen. This has confused many."

                              Is this purely if your account is not in dispute ?
                              Does your account automaticaaly come under dispute when you claim your charges, becuse Natwest just ignore the dispute letter.
