Re: HALIFAX Court case 03rd Oct Help Needed

All your claims were consolidated into one claim by a Judge.

You changed their offer to read that they were settling one claim only and returned it, yet they were only settling one claim because by this point all the claims had been consolidated into one claim.

Your claims consolidated amounted to £1200, but they paid you £2495.

Are Halifax saying that they have overpaid you? Are they unwilling to pay your second claim?

How was the original claim over £4000 ? This was the total of charges in our LBA.

and why was the original offer of £2495 rejected ? Because the total sum was over £4K.

Was this guy going to claim every single charge seperately and add a random £250 onto each one as well as stat interest ?
Yes, that is what we told them, IF they did not settle in full by a certain date. As I said previously, "they didn't, we did".

Have you the speadsheet showing ALL CHARGES on that account (ignoring any spurious £250) simply a list of charges on the account he is claiming against.

So the total of charges was £4000 without any £250's added on ?

I know it looks like we're being picky but we really need to understand the entire claim if we are going to be able to help.

So the total of charges was £4000 without any £250's added on ? Initialy yes.

I don't think that you are! Many thanks.

            What did that total ?

Was he intending to do every single charge as a seperate claim ? Like 160 claims ?

What did that total ? Sorry, not at home, using a friends Internet, but just over £4K.

Was he intending to do every single charge as a separate claim ? Like 100 claims ? No, not really, but it got their attention, which is what we were after.

Re: HALIFAX Court case 03rd Oct Help Needed

well the total claim was £4k - plus stat interest

                forget these £250 fees

so they still owe the difference of £4k plus stat less £2495.

Thats what this final claim should be for.

I want to see the POC and the court docs filed so far before your freind gets booted out of court on the 3rd.

                        Hi! Amethyst,

Sorry, my scanner is broken. Have scanned, using friends scanner, complete file and will transfer from CD to my computer this evening. I will then be able to send you all the info you require.

Again, sorry for delay, be back soon.
