    Still not filed....................... as all three of my claims are for charges are for well over 6 years ago or just over 6 years ago, dont see the point in filing yet till decision out from court on the OFT case. Cos I will have wasted my filing fees if it turns out I cant go back over 6 years after all. And I dont wanna do that. Silly me...................................... so I just wait for now. Spreadies and POCs all done and ready just sat in file waiting outcome of decision on OFT case. C'est la vie, the wait goes on. On a lighter note, flying out to France next Wednesday 12th March to finally complete on the purchase of the holiday home in France. Yaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaay, all my spondoolies winnings now gone, but on a very very worthy cause, A HOLIDAY HOME IN THE SUN. Yaaaaaaaaaaaaaaay xxxxx

        THAT, my dear Mocha, may well be do-able, but I need to wait till builder has finished tearing things apart and putting new things in, and Im off out there for three weeks end of July with paint and brushes to ensure the place is ship shape for the future, then I will see what can be worked out. Lol. xx

            Hi
            I'm new to this site but have already claimed back £5,800 back from abbey 14 months ago. Since then they have taken another £1780 in charges, so now for round 2. Do I have to go through the same procedure as with first claim. e.g. LBA with list of charges attached, wait for their bugger off letter then file a court claim or will it be easier 2nd time around. Can anyone help please

              Hi there, and the bad news is.................................... yes, you have to follow exactly same procedure second time around. They wont give an inch. You have to fight all the way. Sorry I cant give better news, but that is the way it is, its just a little easier the second time having done it the first, but just follow the track as you did the first time and all will be fine..................................... touch wood. Sorry I cant bring better news for you, but they wont budge an inch even on a second claim.

                Hi Tracy and welcome to LB.

                Firstly, you should start your own thread and as Fendy has already suggested you should follow the same protacol as you did before. Follow your timetable and issue your claim in due course. Because of the OFT test case claims are being stayed.

                Once you have your own thread the team will be able to help you in more detail.

                    Well well, two years of everything gone quiet, nothing happening with bank claims etc, and then suddenly out of the blue, yesterday I get letter from Abbey/Santander (I actually completely forgot I had filed at court for this one), and here is what it says:

                    We write further to the above matter, blah blah blah. Please note that we have recently written to the Court to request that it considers making an Unless Order in respect of your claim. As a result, please find enclosed herewith copies of the following:

                    1) Letter dated 28th October 2010 sent to Keighley Court.
                    2) Copy of the Proposed Unless Order.
                    3) Summary of the Supreme courts judgement in the proceedings between the OFT and the Banks (Test Case).

                    We trust above is self explanatory. Please note that if you wish to make any submissions in respet of our request you should write directly to the court and send us a copy.

                    Yours faithfully.


                    What the heck is an unless order. What theyre proposing in the directions to the judge in their letter states:

                    1) Unless the claimant files at court and serves on the defendant his amended POC with a properly verified statement of truth, which disclose reasonable grounds for continuing with the claim, within six weeks from the date of this order, then the claim will be struck out without further notice.

                    2) Thsi order has been made without a hearing under the Courts case management powers contained in the Civ9il Procedure Rules, Part 3. You may within 7 days of the service of this order apply to the court to set it aside or to vary the Order pursuant to Rule 3.3 (5) of the Civil Procedure Rules. If you do so, you must file with the court and serve on the other parties an appliation that sets out yoru reasons for objection.

                    Any ideas on what I do next anybody ??? Is this matter now dead and buried and I agree, to leave it alone, or do I do anything else to pursue this claim in some other way. What the general position on these claims going forward. I have to admit I have just been way way way too busy to keep up with the current state of affairs on these bank claims.

                      An 'unless order' is a 'unless you do something, something will happen' order, their draft spells out what here

                      And no, there arent really any arguments you could use without massive effort and risk, bank charges claims are dead in the water for the average consumer, so I would let it go.

                      Many claims were put on hold until November 2010, so I expect a massive flood of these types of letters coming through to claimants across the country over coming weeks.

                        Once again, thank you soooooooooooooo much for answering. I think, all things considered, Im in a good financial position now, and have no need of this money anymore, so I shall take my leave of the bank claims, and accept that I suppose, YOU WIN SOME, you lose some.
