      Cel has passed my case to one of her colleagues. He is going to deal with it from now on. I will post regular updates as the case progresses and I would like to place on record my sincere thanks to all of you that have shown an interest and offered advice and support. On conclusion of this case, win or lose, I will make a significant donation to this website. Note to CleverClogs, you have amused me with your names for Lowells.         Even more amusing is that they also operate another company called Hamptons Legal - link - which they state "is the legal department of Lowell Financial Ltd."

        Not only does this seem to imply that all their other departments are somehow illegal, it is evident they are unfamiliar with rhyming slang - link

          Just to reassure GJ, (and everyone else) none other than PT2537 is handling this stat demand. I almost feel a bit sorry for Lowell LOL!!! :santa_smiley:

            Interesting development. BW Legal have written to me twice this week. 1st dated 3rd December stating that they have been instructed to represent Bowell Portaloo. 2nd dated 5th December stating that as I have not responded to the SD, a Bankruptcy Petition will be issued on the 21st December unless I propose a repayment plan. Do these people actually know what there doing ? The plot thickens.

                Although I agree with Flaming Parrot, best to double check stuff rather than just file the letters away; do they have a reference on the letters ? (ie. is one for each different Stat Demand?)

                Have you a receipt for your intial set aside application?
                Has your set aside application for the second SD been submitted yet? What date did it need to be in by?

                  I never said they should file the letters away, :nono: certainly not when we're dealing with a SD. :scared:

                  I just assumed that, as PT was dealing with this case, the OP would forward any correspondence received to him. That's what I would do if I had a lawyer acting for me.

                    One might wonder if Bowells had pushed out so many SDs (Smelly Dumps?) that they have now lost track of which are being contested and which aren't.

                      PT has everything in hand. I have been given a hearing date of 2nd January 2014. We are hoping the Court agrees to hear both SD's at the same time. 12 + 2 days has expired now for the CCA, so Bowells are now in breach of s78 CCA 1974.

                        LOL, I think they have more than a failure under s77 CCA 74 to worry about, in fact theres four main grounds which appear to me to support the view that the SD ought to be poked back up their buttocks.

                        And not to mention the mongs will have a second application to worry about in er bout 2 days time.

                          BREAKING NEWS - PT2537 has inflicted a humiliating defeat on Lowell Portfolio who in turn have waved the white flag of surrender

                          Both Statutory Demands have been set aside. I can't thank PT enough for his pure professionalism and extensive knowledge of which I am in no doubt has brought about this decision. Throughout this ordeal PT has been in full contact with me offering advice and reassurance. Special thanks also to Cleverclogs, Flaming Parrot and Amethyst. I would like to know 2 more things please. The first being how to become a VIP member, so I can contribute and reassure anybody else who finds themselves in my situation.
