    Re: Points of Law

On some forums if you can click on the posters name you can then see what topics they posted in or what thread titles they started. If you can't find a link to the threads in your e-mail.

I saw on a Watchdog program few yrs back. That with some of the firms who bought up other peoples debts. All sorts of extra or bogus charges were included on to the original and several were sold on yet again.
It was proposed that people who did not think the debt was all theirs or justifiable, that they had a right to insist the debtor prove by supplying the original bills and amounts. If they could not do so, then a Judge would be more inclined to decide in your favour as to how much was likely your obligation to pay back.

Is it possible that you can show how much you think you owed originally and supply the evidence to the Court.
I do not know how Court works. I'll have a look and see if I can find the program on you-tube.

I can't find a Watchdog prog. Could be Dispatches.

      https://www.youtube.com/watch?v=zeenYRgqICo

Link does not appear to work but you can type in on you-tube
Dispatches U.K - Debt Collector. The truth about collection agencies. Part 4 and it will come up.

Not sure if the comment below is true but it could explain why they say the 2 work phone numbers given were recorded as being 'Dead'.

Reluctant, you are a star. I just hope that jazzhands comesback on here and gets in touch with Katie as advised by Ame above.

nope - you have to click the globe (link) button (middle row of those above the reply box) and insert the url in the pop-up box :tinysmile_grin_t: x

Just had a PM from jazz; no joy using the link on Amethyst’spost so I suggested a PM.

                    Re: Points of Law

sometimes I think you can manually type the url of the link into your browsers search bar.
Or words to that effect... and find it that way.

Here's another tv prog about bank charges if interested.
I don't mean to spam a thread. So if it's not relevant enough to Jazz's case then I'll understand it being deleted.
                    It's titled...
                    Watchdog ends bank charges battle.
if link doesn't come up in blue.

OK, Jazz is at work at the moment and may not be able to contact anyone until this evening. This will be the last chance to get any help before facing the music tomorrow; hence my eagerness to get someone to read this thread last night.
                        Will Kate be available then?

                          Re: Points of Law

OK, sorry, no developments so I will advise as much as Ican. I have been trawling around and pestering contacts to try and find out what can be done.
First of all; try not to be afraid and try and get a good night’s sleep. Have a glass of the hard stuff if it helps. I will be around tonight until you log off so if you want to post on the forum or PM me because you can’t sleep even if it is only to talk b*****ks it might help take your mind off this crap.
If you do post on the forum try and keep on this one. I know it is all different topics but it is all under the same issue and splitting them up has caused some confusion.
The opposition are fallible for all their fancy jargon and flashy suits. They are also universally hated.:censored:
They may give it the Perry Mason showboating their legal knowledge but they are basically using the old ‘baffle them with bull’ technique and do not be afraid to ask for clarification if you do not understand anything when you get a chance to speak. Tomorrow is about you; for everyone else it is just another day in the office.
Remember that if the judge has adjourned the case before because they could not prove they had called you then what are the chances they have suddenly discovered proof? Pretty low I would say. Also if they do come up with proof you must let the court /Judge know that you have offered £90 pm in repayment and bring the proof that they refused that offer. Also mention the £1700 which I am astonished they are not tearing out of your hand as a settlement.:confused2:
On the off chance that that you do loose find out if you can appeal. As I saw I have no idea how these things work. It is strange but I have the weirdest feeling you will win. –not just saying that to cheer you up and I don’t have psychic powers!

I have found these details –don’t know if they are any good or can help but you never know; it will only be a phone call and you may get to speak to someone who can give you some sound legal advice.
                          Civil legal advice
0845 345 4345 (or text 'legalaid' and name to 80010 to get a call back)
They are working until 8.00 pm tonight.

I also found the Law Works Clinics Network. The Law WorksClinics Network is a nationwide network of free legal advice sessions which LawWorks supports. There is one based at Hull Uni. http://www2.hull.ac.uk/fass/law-school/legal-advice-centre.aspx
I am afraid this only operates during term time so no good now but may be an option for the future or if this case drags on.
No matter what happens tomorrow please come back on and let me know how it goes via personal message or forum. For what it’s worth I will be thinking of you.

                              Re: Points of Law

Thank you everyone for your help. I could not get back on last night - it was actually my birthday yesterday - and although I had told my family I was really not in the mood for celebrating they had prepared me a lovely meal. I am also extremely run down and have developed a bloody awful head cold, so after only 1 glass of wine and a couple of Ibuprofen I went to bed. However, here I am at stupid o'clock (4:40am), stuffy head and unable to sleep. I am so worried. I never imagined the effect this would have on my life, and how it has consumed my every waking (and sleeping) hour I know you do not know me from Adam, but the one principle in my life and something I have always fought for is fairness - and this all seems so unfair to me, and how the Government, or whoever decides these things, can allow this to happen is beyond me. I am an average person, I work as a medical secretary in a GP surgery - I don;t earn a great amount by any stretch of the imagination. I've never been out of work or claimed benefits,. I wa a single mother for most of my life and managed to buy a little terraced house 15 years ago (I'm 51 now), and to know that is possible for some company who's sole purpose in life is to profit from people who are having financial difficulty just sickens me. On their website, 1st Credit claim they are "fair, sensitive and ethical" . They say they are trustworthy, and that being open, honest and transparent is part of our culture. . Apparetly their values are " To reat every customer as an individual, listen to their story and help in the best way we can. Our focus is on building relationships, not quick fixes". I have never read such ******** in my life. I feel so many emotions just now - I am angry, frustrated, and so bloody scared - scared about what is going to happen later - the fact that my whole life may change and everything i have worked so hard for is going to disappear because some blood sucking, life sucking company want their pound of flesh. It sickens me even more when it is not even their orginal debt. They chose to buy the damn debt. God! I feel sick.

Jazz, I am so sorry I missed you last night. This is not going to change your life. You will get through this. You have a family that love you so much and I know that sounds clichéd but it is worth more than gold.
                                Happy Birthday by the way!
I did sent Celestine a PM but I do not know if she has had a chance to see it.
What time are you in court?
I am so very sorry I could not give you any sound legal advice but what you already know should stand you in good stead. Please just keep your chin up and fight these bastards.
I have to go out for a while this morning but I will be here for the rest of the day.:_tighthug__by_darkm
