We'll help all we can, once you have the SD we'll see what it says and start drafting set aside application.

As I understand they should put anything in writing? I am wary of speaking on the phone to them, his message was quite aggressive sounding...

Re: Help! Notice to serve a Statutory Demand and I dont know what for.

                        Hi I will help you.
Redwood are in fact the sons of the owner who had a company called Connaught collections which was sold.

now this company is cut throat. They are just a servicing company (which means they chase the debts for someone and keep a cut)
However the law states that the owner of the debt HAVE TO tell you if this account has been sold or pasted on. (a goodbye letter)

if this hasnt happened, all you have to do is ask redwood for a letter from the debt owners, saying they are now collecting on there behalf.

in this call (or letter) state that you want a grace period of 30 days until this is sorted, and that there actions so far are being noted and will be reported to the FCA. (you must notify the FCA..... dont just say this)

if they say, they can do what they are saying, remember.... they must PROVE they are chasing the debt and you NEED confirmation from the debt owners.

I will let you know that they send stat demands (im going to make you bankrupt) out to EVERY customer.. by law they have to follow through with a % of these or they can lose there licence.

remember they sell the fact that all customers will pay if they send this kind of letter to the company they are working on behalf of. (remember its the company that take the cost for the court not them)

Report back to the company you had the debt with state that you can pay at an affordable amount each month, and that you want another company to deal with this.

between you and me, i understand that they sold of Connaught quick as they had two lawsuits against them

Have recently moved house, previous landlords did not pass on post (even though we have asked repeatedly) so presume all previous demands have been lost.

The only thing I can think that it might be is a previous employer who I left in a hurry due to terrible H&S (in my work we go to prison if there is an accident due to negligence- probably whole other thread though) I had unfortunately had training and this employer has a history of chasing for training costs, so I am guessing is this.

Can they serve an SD if I dont have a record of any previous demands? Can I write to them and demand a detailed breakdown of this supposed debt? Will this stall the delivery of the SD?

I clearly need to get this sorted but I have no idea what/who I am fighting against!
Desperate for advice, cant afford solicitors at all.

                          Thanks in advance

                          Hi Bloodyworriednow.

                          I will help.
first of all. your LEGAL right is to have a full breakdown of the debt. please send this. I know redwood well. I worked at Connaught Collections, which was also owned by Chris North. (they sold Connaught to First Credit) and then opened Redwood.

They are a bunch of cowboys. The company is run by Chris Norths sons, but they have no idea what they are doing without there daddy. At the staff are kids with no experience, which you can see fro there website. they are all barely out of nappy's.

Tell them you will report them to the FCA, as the FCA are looking to remove company's like this. Highlight the fact that they send Stat Demands to EVERY ONE of there customers and they only follow through with a few. sickening and wrong.

Its a bully tactic we used to scare the life out of people. the FCA will love to know they send stat demands to every one as they are meant to follow through with these.

Mr North... thats for firing me for being late.

Hi Scott, Sorry for late reply, and sorry to hear you lost your job.

Do you have evidence that RedWood send Stat Demands to all their 'customers' ? - we haven't had many reports of Stat Demands being received by consumers from RedWood on here, there's a few on CAG but nothing indicating they use SD as a matter of course.

If you did have evidence this is their technique and they have no intentions on following through on the SD with a bankruptcy petition you should pass that information on to the FCA.

Hi Sharon. I worked there and believe me, EVERY customer got one.
There is no law stating what amount of SD you have to follow through with so the FCA cant help. Also customers need to remember that if it is not consumer debt, then the FCA cant act on anyway.

But I will tell you this much. They have to get the original lending/company that hold the debt, to pay for the bankruptcy, as Redwood wont pay for it.

It all comes down to them.

                              Scott
