                  Hi Guys- Update on Stat demand with Cabot.

                  As you know from my last post I sent a CCA request to Cabot which they received on Mon 9th June

                  Well they replied on 12th June (3 DAYS LATER TAKE NOTE GUYS) with this :

                  Dear Mrs X

                  Re: Next Retail Mail order xxxxxxx £1,601.30

                  I refer to your letter received in our office on 11th June 2014

                  Thank you for your request for information under the Consumer Credit Act 1974. Unfortunately, it appears that Next are unlikely to be able to provide the requested documentation. Therefore, I can confirm that Cabot Financial (Europe) Limited have taken the decision to no longer pursue collection of this account unless this information is obtained in the future.

                  Please note that this decision is not to be confused or interpreted as a write-off of the outstanding balance on your account as the debt legally remains. In addition, i can confirm due to the time elapsed, this entry should no longer appear on your credit file.

                  If you have any further queries, please do not hesitate to contact me.

                  Customer Care department


                  Well, well, well, what a turn around and what a reply !!!!!!!!!!!...after Cabot relentlessly sending threatening letter after letter for months I received a Stat demand and as advised by Our wonderful Kate who is preparing now to have this Statutory demand to be set aside, a CCA request can stop them in their tracks :beagle: .

                  These people prey on the fact that people don't know the law or their rights. Disgraceful how these companies operate and cause misery and distress for many.

                  Kate is now going to finalise this :tinysmile_grin_t:

                  I have learnt so much from this and although it was unpleasant and a shock to begin with, finding Kate and Legal Beagles has been a Godsend and I would be a basket case by now if it were not for you guys.

                  Anyone else reading this who is in a similar position.........don't panic:tinysmile_aha_t:.....Speak to Kate (Celestine) and the team, find out your rights as KNOWLEDGE IS POWER and proceed with confidence.

                    The statutory demand issued by Wright Hassall Solicitors on behalf of their client Cabot has now been formally withdrawn against Bosh.

                    I have also formally placed them on warning that the debt is in breach of s.78 CCA 1974 and is therefore up enforceable until they ever locate copy agreements etc and that they should not harass my client to recover an unenforceable debt.
