                  Ok. Witness statement 6.5 has been submitted to the court. Celestine has also sent the Notice of Acting N434 and Notice of Funding N251 to BW Legal. it was 6 years on 28th December since last payment or acknowledgment of the debt. Blowells haven't responded to my CCA request. If I am fair and take into account public holidays and weekends, 14 days (12+2) will be up on Monday as it was received by blowells on the 18th December. I haven't received any acknowledgement letter to date that they are even looking into it.

                  So here's hoping....

                    It is hardly uncommon for Bowells to commence a claim or issue a Statutory Demand without first getting a "twue copy" of an agreement from the original creditor.

                    I sincerely hope that you'll be able to get the SD set aside or that Bowells will discontinue as soon as they see that Kate is on the case.

                    When they try again, the debt should be reliably time barred by section 5 of the Limitation Act 1980.

                      Ok. So 14 days has passed now since I sent my CCA request and I have heard nothing. So they have now breached the CCA. the court has passed the application to set aside to the district judge for directions.

                      So fingers crossed.

                        Everything will be absolutely fine Philip. Post here if you hear anything from Lowell's cos I can't access my work emails while away, but I am keeping an eye on the forum. Even though they know I'm acting for you it's not uncommon to still receive letters/calls until they wake up and realize they are screwed. If you're at all worried, speak to PT2537 aka my collleague Paul Tilley at Howlett Clarke, but seriously, don't worry xxx

                              I had almost resigned myself that they were going to go to court.

                              The debt is now statute barred so no more legal action.
