  • Lowell/BW Shop Direct statutory demand

    I am looking for some advise on a Stat demand received from Lowell/BW legal today. It arrived at 19:20 24/10/2013 by person.


    The claim is for four accounts i believe with shop direct, i had initially disputed the minimum payment on these accounts last year. I have been awaiting a satisfactory response and was in the process of writing financial ombudsman complaints which i haven't been able to send off yet. However both shop direct and Lowell were aware i had made complaints.


    The amount is over £9000 which i do not dispute as clearly i know what had been spent, and i certainly want to pay the debt back, however i at the time i was unsure why the minimum payments were rising so quickly hence the dispute, i am now unsure whether they were or I was in the wrong. I have previously advised Lowell by email that i intended to raise a financial ombudsman complaint. The accounts were opened around 2010/2011.

    I forgot to mention that from Jan this year my work was under threat from closure and were paying us on short notice etc before being made redundant in July which made things more difficult. However i now have a new job albeit temp.

        I keep getting phone calls from BW but haven't answered any yet, they only started 4 days after the SD was served on me though Which is interesting in its self. I wonder whether i should answer and maybe see what they have to say :tinysmile_hmm_t2:

          Haven't you instructed Celestine to deal with this SD for you? In which case BW Legal should not be calling you direct :nono:

            I'd say it's best not to speak to them at all. If you answer the phone, just refuse to answer the security questions and hang up.

              I think so, however i haven't had any contact with Celestine from last Tuesday so unsure :confused

              Its one of those things i just cannot deal with at the moment apart from working 12 hour days on a temp zero hour basis and worrying about this, and a million other things.

              As far as i am aware the 18 days runs out on Sunday so i either offer to pay up in instalments just to get it over with (i know thats what they want) or get this set aside form.

                Sunday is ages away and certainly plenty of time for Cel to knock this on the head or make the application for a set aside. If you've got a winnable case she'll win it for you, if you haven't then ask her to negotiate a deal for you. Cross that bridge when you get to it next Sunday

                  It is but is certainly doesn't feel that way everyday when all we can imagine is having to move out of our house when its repossessed for £9000. :tinysmile_hmm_t2:

                    It won't be, have you any idea how many SDs Cel has managed to get withdrawn/set aside, almost all from Lowell? I think she posted somewhere it was around 35, 50 expected by the end of the week! :whoo:

                            For reference, when a statutory demand deadline falls on a weekend, the deadline becomes Monday.
