Unfortunately any "open " access point can be used. Window or Door FM, despite the new rules it still happens.
As far as I know the new rule has yet to be challenged.

Still ... the new regulations clearly state that access can only be gained via a "usual means of entry". The bailiff would probably lose his license if he attempted to climb through a window now (although access through an open garage is permitted).

Also, they should not force a door (if it is on a chain)

I agree Bizzybob this rule needs to be tested I know such entries are still being made.

Too prevent hijacking the OP's thread and to keep on track maybe a discussion thread on this subject could be started, as it is most certainly an issue to be addressed. What evidence have you on these unlawful entries, and are specific EA companies indulging in this behaviour is it an "In General" activity across them all?

It appears to be " in general" activity.
Even some CC bailiff it seems are " unaware" of changes recently coming into force.
As usual EA's will exploit the lack of knowledge in the general public much as the DCA's
do on a daily basis.

I'm unable to post "specifics" at present as the matters involved relate to "3rd parties" I am assisting.

OK, but the EA's dealing with the third parties MUST be told of their "Mistake" and that their entry and any subsequent Control of Goods Agreement may be faulty., under the new Regulations. that should kill their pig for them. Well stun it maybe.

Now a question foir janeyjewel, have the bailiffs been back, and did they come with a van, as in a vehicle capable of removing large items. A Luton Transit or similar rather than the usual Berlingo they swear is like a TARDIS inside.

Janey - as said we need more detail. If you could answer the questions raised we would be better placed to help.

This is the first case I've heard of of an EA trying to climb through a window since the new regs came in. It is clear they can only enter through a normal point of entry, so front door, back door, patio windows pretty much covers it I think.

If they are seen trying to enter via a window, video them and complain. Clearly any agreement would be worthless.

It is usually best to keep the bailiff out and engage with them , or possibly the original creditor in writing (email is fine) to reach an affordable agreement.
