    With capital contribution it is actually normal for your partner's assets to be taken into account if you put her down on the original form.

      That would surely depend on whether it is a 'partner' or a current 'girlfriend'. Surely it wouldn't be right if the situation was something along the lines as the OP moved in with his girlfriend a few months ago and then suddenly her assests are considered fair game for the Legal Aid calculations.

        What adress was the OP at when the Original application was made for legal aid was would matter in the assessment?

        The Original paperwork must surely contain all the working out for the OP to be able to Receive the Aid after all it must be a fairly long winded process to get money from this legal system?

          Yes, indeed. That is why I said, "if you put her down on the original form." One would not expect a relationship in its formative months to be put down.

            Rossendales Capital Contibution

            Hi,

            I have had a letter from Rossendales stating I owe £1500 in capital contribution costs. They say I owe this as my partner has equity in her house. I am not on the deeds or mortgage.

            my question is, if I do not pay, what action can they take to my partner?

              Defeated Rossendales!

              After Rossendales sending me letters asking for a £1500 payment towards my defence costs I have finally defeated them.

              They calculated that I owed them this money because my PARTNERS house had 50k equity init. This of course was bullshit, so I got 2 property evaluations and phoned the bank for a copy of the mortgage.

              I then sent all documents to Rossendales to re-calculate, as if the equity is under 30k then no payments need to be made. The equity came to around 28k, so nothing had to be paid.

              the moral of the story is don't be threatened by their bullshit claims that they are going to send the boys round if the money is not paid within 14 days, fight your corner and defeat the mutha fukas just like I did.

                        Excellent result - well done. I think the main thing to be aware of here is to check the figures for yourself. I made the mistake of accepting them, and suggesting your best route was to come to a repayment arrangement, I apologise for the wrong advice.

                        Capital contribution orders are usually pretty straightforward, as the rules governing them are tight. The one variable though is, of course, the value of the house - well done you for spotting that and getting it changed.

                          Hi,
                          Can anyone help please. I had a court case which ended in June, I pleaded guilty and was given a 2yr suspended sentence and 200hrs community service. I received a letter recently from Rossendles saying I Owe £61k for capital contribution order (legal aid).

                          I don't have any assets or savings and was granted full legal aid And had to pay noting. Rossendales are threatening to put an order on my wife's property that she owns a 100% with no mortgage.

                          When I first applied for legal aid my wife and I signed the legal aid documents to show our income. Now I am worried because they are threatening to put an order on my wife's property if I don't pay the £61k.

                          Can anyone please help.

                            This is what happened with me. I lived with my gf at the time I went to court. I had the same letter saying I had to pay 2k court fees. My name was not on the mortgage at the time but because I liv d with her they still said I had to pay.

                            the reason I had to pay according to them is because there was more than 30k equity in the property. I got 2 estate agents to value the house, to people I knew and they valued the property at a value which left under 30k equity. I emailed rossendales these valuations and I had nothing to pay to them.

                            what I would say to you is find out how much the are valuing the property and get valuations of a lot lower. Still 61K seems a lot to pay!

                            Do you,live with your partner? I can't see where they got 61K from that is nuts. I would challenge this payment as it seems extreme.
