Witness to a Marston's bully boy verbal abuse on two vulnerable people, I stepped in and paid their debt for them ! My good turn for the day (This was back in April). Requested a receipt and told to #### off cos your not getting one so #### you. Then followed text back and forth for a month requesting receipt but nothing. Contacted his bosses at Marston's who must have told the idiot off. This resulted in phoned threats to me (I know where you live etc etc I can do what I like to you etc etc the Police are on my side etc etc). Still no receipt. Got call from Marston's with apology verbally for his actions. Requested this in writing but they refused. Threats on and off since via withheld number calls at all times of the day and night !!!! Still no receipt. Today 23rd July, still no receipt. Just rang Marston's who just put the phone down on me .

Bailiffs goes by the name of Kirkcaldy, is faceless, has no bricks and mortar office address and no morals. Latest laugh is that he has reported me to the Police for harrasment .

So what do you reckon to that ?? Anyone know where he lives so I can knock on his door ??

Best thing to do my friend is tape the calls and log the times.
I did check the bailiff register and this is the information I found.....

If you are absolutely sure that Kirkcaldy is the perpetrator, and you have proof.
Write to the court that issued his licence and make a complaint.
They are obliged to investigate your complaint and can revoke his licence.
Also you can complain to the Civil Enforcement Group. http://www.civea.co.uk/complaints.htm
Next thing is to complain to the police about threatening phone calls, and request a CAD number.
This is a unique number logged to your complaint.
Write to the employer Marstons Chief Executive Officer, Mr Gareth Hughes *Headed Private & Personal*, stating that you have reported threatening phone calls to the police and give them a copy of the CAD number.

If you can, check with the two vulnerable people and see how much their original debt was for.
Then look at the amount you gave the bailiff.
I got a sneaky feeling that the reluctance to give you a receipt, both by the bailiff and his employer, was because they have added unlawful charges....
Newlyn PLC tried that one with my daughter, adding some £254.00 to the bill for services they never carried out.
Unfortunately for them, I spotted it, and now it could very well end up in court with a claim for compensation.
You gotta watch these sneaky buggers.........

This EA has seriously compromised his own position and that of Marston Group by his actions.

You are entitled to ask for a receipt for any monies paid and he knows he has a responsibility to issue a receipt. How else can he account for money he has collected? So your repeated requests for a receipt are not harassment as there is a provision within the Protection from Harassment Act 1997 that excludes conduct that is reasonable in the circumstances.

But where the EA has dug a hole for himself and Marston Group is his conduct towards you, including -

a. making threatening phone calls; and
b. making a false report to the police.

Of the two, b. is the most serious, as he could end up being sent to prison if the police see fit to arrest the moron. One weapon to have ready, if needed, is something called a Part 8 Injunction. These are drawn under the civil remedy provisions of Section 3, Protection from Harassment Act 1997 and have a sting in the tail for those who see fit to breach them. Hopefully, you won't have to seek a Part 8 Injunction, but bear it in mind just in case.

This is prima facie evidence that you can change the law, the MOJ and government can spout platitudes about reigning in bully bailiffs, change their title to Enforcement Agents, but so it would appear you cannot change the bailiff. As in a pitbull is still a pitbull, and will always revert to type. In the case of bailiffs/EA that is usually a bullying thug who will cause grief for debtors and innocents alike with no fear of retribution for their own unlawful actions.

As long as you have 'evidence' and not just hearsay....
There are bully boy bailiffs out there, who try every trick in the book to extort money from defenceless people.
They should be named and shamed, maybe on site like this one.

I think if the site admin is happy for bailiffs or EA's to be named and shamed it should perhaps be on a new thread, and with a description of what the bailiff has done. Otherwise we might as well start at the beginning of the register and just take turns to type the names out! :beagle:

Perhaps there should be a special forum where instances of good and bad practices by EAs, civil enforcement companies, police forces and other public authorities can be reported.

I don't think that is a particularly good idea. If there is a case where a particular enforcement officer is involved then it is okay to name them to assist investigation,checking they are properly licensed etc. , however they should always have right of reply and it should not become a personal attack.
