  • County court judgement

My Company has a registered office but I use my home for mailing requirements. I have had the sheriffs bailiffs round although I don't solely own the property I live here 50 % belongs to my brother as with 50% of the good as it was our parents home. Can they take goods that are not fully owned by myself. This is a Company debt I did not even know I was being taken to Court Need urgent correct advise please

If it is a debt against a limited company, only goods belonging to the company can be lawfully seized. Does the company have premises from which it trades? If so, HCEOs can force entry and remove goods belonging to the company. They are not allowed to force entry to residential property. They are also not permitted to seize third party goods, that is, goods belonging to someone other than the actual debtor.

Legal documents served on a company are always served at the company's registered office address in order for the documents to be deemed served.
