    interest will continue to accrue at 8% per annum on the full amount of the judgement debt and costs until payment in full.a walking possession fee of 25p per day may also be charged where we go into possession of any goods.

      Have just sent stay of execution form with the £80 fee but they said it can take up to 10 days and that's not gonna stop the douche bag from returning is it

        Where have you sent the Stay to? It must go to the High Court in London or a County Court that acts as a District Registry. What were your reasons for applying? To do this you must also have known the County Court Claim No?

        I would have advised you to have taken it in person and asked for an urgent hearing - usually done within 30 minutes or so.

          Northampton county court reasons am not knowing about the ccj and our household being vulnerable also we can not afford the hceo fees I rang marstons and they have me court case number we couldn't take it there in person it's miles away

            You didn't have to take it there it could have gone to any County Court with a District Registry. Anyway you have done the right thing it is just going to take a little longer.

            You mention vulnerability - can you explain a bit more? The other thing you should do now you have the CCJ number is to ring the Court and ask if they can send you the paperwork - particularly the Particulars of Claim & Judgment.

              I have 2 disabled children and I also have manic depression which I am on medication for also several other medical problems I suffer badly with panic attacks high and low moods also suicidal thoughts in the very bad times the stress of this is making me worse also cause of my disabled children who I get dla for both of them I'm terrified of him turning up again

                have you made Marstons aware of this. They also have a responsibility to treatly you fairly, if contacting them ask to speak to the Welfare Dept. It doesn't do anything to make the debt diappear unfortunately but they should treat you according to these conditions. They will ask you to provide proof but a letter from your GP or other medical professional will help.

                  I have appointment next Wednesday to get malg form filled in off doctor and also have got few letters printed off to give him if he returns one removal of right of implied access

                    Have you contacted Marstons & if so told them you are getting the information required. Removal of implied access will not work in this case.

                              I'm sure he prob laughing already thinking he gonna get £300 for himself so here another question how many times does he have to come out before it's referred back to the court some say 3 times others a month others 15 days

                                There is no hard & fast rule over this. As the HCEO only gets paid on results then in theory thy will try to probably make at least 3 different attempts at differing times of day including an evening visit. If he does not meet with the debtor he will not waste too much time as he is not getting paid. With residential addresses the HCEO has no automatic right of entry and cannot do much more. Eventually it will be sent back to the Claimant but that does not prevent them from employing another HCEO or another type of enforcement - charging order, oral questioning over your means etc.
