    About time Serco Group was investigated and compulsorily wound up, further as per OP's post:

    "I have just rung Collectica and they have said unless I agree to pay £250 a WEEK then no further action will be taken. I only earn just over that!"

    Surely the bailiff is on shaky ground refusing a reasonable offer and demanding virtually the whole of a debtors income as a weekly payment as in say £260 per week, Collectica want £250?

    Surely even Sir Vere would agree that is ludicrous.

      Nothwithstanding, in the Judicial Review in the Purnell case, HMCTS took a right royal slapping from the High Court over its computer system and means form, both of which were branded "not fit for purpose". In addition to this, the HC confirmed that a defendant's means must be examined, otherwise a fine cannot be imposed or enforced. Furthermore, if after having a fine imposed, a defendant's circumstances change or they incur additional fines, then their means need to be further examined and the amount of payments and the period of time over which they are paid adjusted.

      HMCTS court staff need to remember the Purnell case or need reminding of it. Defendants also need to be told, on being fined, of the need to notify the court of changes in circumstances. Yes, it is acknowledged that the level of unpaid fines is high, but that does not justify the use of private-sector companies whose only priority is the bottom line.

      The new regulations coming into force on 6 April claim to be the means by which the rogue elements within the civil enforcement industry will be removed. Removing the private sector from the public sector would be better. Private is not cheaper or better. Beware the siren voices of the Square Mile.

          Having read this thread for a second time, I note the OP is already paying a fine by Attachment of Earnings Order. I am aware of a similar case that occurred near to where I live last year where two fines were combined using a Consolidation Order. It is my understanding that two different forms of enforcement cannot be pursued against the same person for the same matter at the same time. In the case last year, the relevant HMCTS Area Enforcement Team pulled the Distress Warrant and referred the matter to HMCTS HQ as the cock-up was HMCTS's fault.
