  • Collectica giving 24hrs notice otherwise arrested???!!!!

    I have today had a visit from Collectica stating I owe £910 which £300 is their money!
    They have given me 24hrs notice to pay up or collect goods and arrest me? I don't own a car, or anything of huge substantial money and no way can I find that cash. I asked why couldn't it be paid through an attachment of earnings, but the person said it can't. That is the only way I could pay this fine off unless anyone knows better?
    I just tried calling 02075568500 and they have given me this number - 08448004588. Is this collectica?

    Need help with this ASAP please

    I have just rung Collectica and they have said unless I agree to pay £250 a WEEK then no further action will be taken. I only earn just over that! They also said I could pay less like £20 over the phone or however but it would make no difference.
    What will happen tomorrow as they have been let in like I stated by the landlord. I have nothing for them to take and I cannot go to jail! I would lose everything ( kids, home, job etc )

      I have gone through paper work and only found 2 letters from collectica. One is not dated, other one is 11/11/13 and that is the date the court gave the order to them. Obviously I have a letter from them today too.

      Not once have I had a letter from the court asking for attachment of earnings since the court date 6th sept 2013

          Aha! Just been told that on11/11/13 another bailiff did come to the flat but I was out. This must be the letter I have

            Hello daggz68.

            First thing first.....don't panic, before you are arrested for non payment of fines the bailiff must be able to speak to you face to face, then return the warrant to Court stating that you are a wilfull non payer, then the Magistrates decide what would be the next course of action, and only if, from your previous history, see that you are wilfully trying not to pay fines then they might issue an arrest warrant.

            £900.00 is a lot of money when it comes to seize goods, it equates to anywhere between £4,500 to £9,000 of furniture at new price, and since they can not take your bed (but they can take the footboard if it's one of those fancy ones with a pop up TV in it), any freestanding wardrobes if they contain clothes and most of the stuff in your kitchen is considered a necessity, thus untoucheable, they are left with what's in reception rooms, the odd electronic gadget and the obvious TV and periferals.

            Not wanting to pre-judge, but from what you say in your post, you live in a flat with not a lot to your name.

            No bailiff would waste time and energy in emptying a flat out and send everything to acution if the likelyhood of making the value of the warrant and the auction fees won't go that far.

            Since you work this warrant is not going to anywhere soon and Collectica will want to enforce it. But they will have to agree to a payment plan which will be more or less on their terms, although £250 per week is rather unreasonable, but they might insist on something like £90, which if you possibly can, you would also agree to.

            If that means that for the next couple of months you forget all luxuries in life, such as all types of drinks, excluding tap water and be inventive with your cooking, limiting yourself to bread, potatoes, onions and beans, then you should be able to do it.

              Thanks. I only rent a room and have a cheap tv which cost next to nothing. He has seen that. He kept saying to me am i unwilling to pay. I said i would if i could. I can't get any cash together. That's why I said 20or 25 to them over the phone. The original payments to the courts would have been that

                Is this Bailiff Braindead how can someone pay each week more than they earn if they have no savings and no goods of value where does he think they are getting the money 20 quid a week is an offer to pay it should go back to the courts.

                  I would suggest that the Landlord letting him into your accomodation is a no-no. Going back to the fine itself - did you know about it? Did you attend Court? have your means been taken into consideration? Did you receive a letter from the Court asking you to pay before the Bailiff turned up?

                    Yes I knew about it but I already have an attachment of earnings Im paying off. I was means tested at the court to pay 25 or 20 a week. No I have not had any letters as far as i know from the court

                      Sorry if I appear to be a bit thick tonight - it's been a long day. Did you make any payments as ordered & if not why not? - please note I am not judging you. You should have received a letter along the lines of:
                      "you owe £xxx and have failed to pay as ordered if you do not bring your account up to date within 10 days then the following may happen:
                      bailiffs will be one of the suggestions they make"

                        No I haven't made any payments as I have been paying the other fine off. Not received any letter like that as far as I am aware. If they had gone down the attachments of earning road which I tried to get them to do today I would have paid and had to of paid.
                        Forgive me if I have been informed wrong,if the bailiff cannot get anything from me a third time, it goes back to court?

                          I did write that £250 per week is unreasonable, as the OP only earns a little more, however, unless the OP can prove to the bailiff that his necessary outgoings are £225 then he would be expected to pay more.

                          After all a fines are a punitive imposition, and are supposed to make the convicted person go through a period of financial discomfort.

                              It would appear that not content with being caught ripping-off the MoJ over a tagging contract, Serco seems to have hit the self-destruct button by letting Collectica behave like a bunch of out-of-control hooligans. The last time they behaved as they have in this thread, an HMCTS Area Enforcement Team pulled a Distress Warrant. How many times must this happen before someone at the MoJ realises something is going wrong and terminates Collectica's contract?
