      Is this another faulty trace, or have the court screwed up? Marstons don;'t care who pays a debt they will even encourage a third party to volunteer to pay it if they can.

        That's pretty much what I'm hoping. As I said in an earlier post, I'm pretty sure that it is my fine & someone somewhere has booboo'd. That said, the Stat Dec request was also advised from a court rep due to my having no knowledge of a hearing, & we''re all entitled to have one. All I really want to ask for was (& still is) time to pay & my stuff back. I'd have made the offer of weekly to the bailiff had he not cleared my gear out immediately!!

          And as a foot note, I personally think the text message he sent was an effort to convince me that the Stat Dec will have no effect & just pay up. Well, the way the rhetoric flows gives me that idea at any rate!!

          He's out of luck if that was his cunning plan!!

            If he sends the footage from his bodycam, and it shows a very different name to the one on the Stat Dec, he will look a right tit, and the court may even have a pop at him hopefully.

              Very true. That said, I was under the impression that details had to 100% match. Or am I incorrect about that?

              One thing to another: I have a letter drafted (Sending tomorrow) querying as to why my work tools weren't returned as soon as he was aware they're work tools & where this £150 work tool threshold has come from. Should I send this to the court or Marstons themselves? Or both?

                his reference to the date 20 feb if this was the first time you were aware of the fine when you received the letter then that's ok you have 21 days from becoming aware of the fine to file a statutory declaration

                Its a criminal offence to lie on a statutory declaration so perhaps he is trying to scare you into not making one

                print out the text and take it with you (you never know it might come in handy)

                  Hello Wiccaqueen. :-)

                  Yes, the 20th was the letter date, but didn't actually open it until around the 25th. (I work nationwide for extended periods.)

                  I'm of the opinion he's trying to intimidate by text. Shame, cos I'm not very accommodating when it comes to being bullied!!

                  Can't print it, due to that having been seized! (Another work item, might I add!!) But I will keep it saved on my phone should it need to be seen. :-)

                    One more thing: The Bailiff (A Mr Shaw) doesn't appear anywhere on a certified list. Does this have any major effect?

                        Not really, but the bailiff could not complain about someone filming him with their camera on the same property either.
