      Yes, but....and it's a big but....oddly enough the bailiff is ordered to take your good if you do not pay, this bailiff just jumped the gun......a little too much I dare say!

      You have plenty of room to complain, as proper procedure has not been followed, and you might get some redress, look at the template letters which are stickies at the top of the forum thread.
      The Black rat (Rattus rattus) is a common (hence the accusation of being Pleb) long-tailed rodent of the genus Rattus (rats) in the subfamily Murinae (murine rodents).         Thank you very much Sir Vere. I feel a rather rude letter to Marstons being drafted in the very near future. I also see a very large drink being bought for each & every one of you if I bump into you anytime.

        I'll be taking that up with the bailiff as soon as I get back from work.

          So Elliot Ness is in charge of the Bailiffs now a set of rules that they do not follow no Penalty or punishment for not doing so Definitely the Untouchables If we all behaved in this way Anarchy?Revolution?
          A system needs to be in place to stop those who break the rules from holding a Bailiffs Certificate and forfeiting their Bond

            Don't do rude, just be firm and fair, as a bailiff should be.

            As far as the drink goes make mine a Hemingway, ice and slice!

              You seem to condone the actions I described from what we read on LB there are many Bailiffs who disregard the rules no doubt there are many descent ones we will probably not read about them on here.
              The one Bailiff I dealt with acted as if he was a Mafia enforcer playing the hard man when I raised my voice telling him he had and I was correct no right to be there the Coward run a mile,

              If they get it wrong they should be punished I would be?

                I'm trying to find the template letters (Stickies at the top of the forum thread) but having no joy. Not sure if it's due to my being on here via my phone, but was just wondering if you could point me in the right direction. Sorry to ask, seeing as you've been great for advice, but really can't see to find the correct link.

                    Ah, well thank you muchly.

                    I think I need one to reference Bailiffs behaving badly, as it were. (The removal of work tools, removing goods immediately, PC with client & personal data stored upon it. That kind of complaint letter template!) I'll have a nosey on through & see what I can find.

                      Hi Wales, I do not condone what this goon did or the heavy handed, bordering on the criminal, other bailiffs approaches are.

                      If I knew the guy/gal I would happily slap them from here to Kingdom Come.

                      I strongly believe that "the Industry" should be cleaned up......starting at the top!

                      Bailiffs knocking on doors are the pawns of the game, and they will try to get away with whatever they can, but, if the complaints that land on the CEO desk would be followed up with a P45 I assure you that this type of behaviour will virtually seice overnight!

                        Problem is Sir Vere that is unlikely to happen, in Rich's case the bailiff is up the creek as he has breached DPA, and removed tools of the trade as in a computer, if the hard drive is already wiped and the client data lost, I would consider that Marstons will be liable for loss as there was no opportunity to back up this data, and the value of the invoices lost may well be far more than what they were after in fine and fees.and a kick from ICO. Would this one be serious enough to submit at least a letter to the certifying court of the bailiff if not a Form 4 in case Marstons chuck a brace of Barristers at OP if a Form 4 went in.

                          On LB we read a lot of posts where the debtor is advised to write a complaint to the CEO of the company presuming this happens how many letters does the CEO receive or are these dealt with by someone else?
                          When we add into the number of debtors who do not come on here for advice the amount of complaints must be at a rough guess in the hundreds.
                          Another question for you How many Bailiffs have lost their certificates FOREVEVER in the last 5 years nd which companies did they work for.

                          We all agree the Industry needs cleaning up and the Rogue element removed but all the time thes bring in revenue probably more than the decent ones it will not change Marstons Rand r and all the others only care about the money

                            Text message from Bailiff received earlier today:

                            Been advised by the court of stat dec in derby next week we are forwarding video footage from our body worn cameras of the notice in your bedroom notifying u of our action dated 20 feb and also statements of our phone conversation where u advised me that you disregarded as your surname is not the same as the name on notice and warrant. Also captured by my body camera I suggest you take legal advise before attending court

                            Thoughts or opinions anyone?

                                Letter was dated 20th Feb 2014, but I wasn't there to open it, due to working away. Opened it circa 25th. Called Marstons to query what the reason of the fine was for (Simply got told "Pay pay pay" & no further information was given.The surname on the Distress warrant was for Richard Dardell, which is not my name by any stretch. Well, apart from the Richard. When he called me ( After my stuff was taken, no contact beforehand) I queried the difference in name & was told "Spelling & details don't matter. Pay pay pay. Immediately." Or words to that effect. That was also when I queried his removing of my work tools & was told "I only have to leave you £150's worth of tools for your trade."
