    Hi if any one can give me some advice I'd really appreciate it I'm desperate.
    i have received letters in the post and I have also received hand delivered letters from roses dales bailiffs statin they have a warrant to gain entry to my house to take my property?
    I don't dispute that I owe council tax for last year and this year, I just can't afford to pay the amounts they are demanding.

    last years council tax:
    i am currently paying roses dales £150.00 a month, I have received a letter to say that if I am late with any payments or don't pay I will be sent to prison.

    this years council tax:
    i am currently waiting for roses dales to attend my property to gain entry to take my property? I payed them £500 last week and was told I had 7 days to pay the rest £600? I offered to pay monthly but they refused and said they were on there way to empty my house as I couldn't pay them on the 14 th feb? Please help

      So to get this straight, and welcome to Legal Beagles Nicky, Dossers are calling for 2 sets odf council tax arrears? If so it is a Liability Order , they cannot be acting as High Court Enforcement Offficers for council tax.

      Now take a deep breath and consider this.

      You made a BIG mistake letting them in, as there is no law that forces you to do so, however once you let them in it opens a whole new world of fees and ways for the lying cheating dosser to fleece you.

      How long has this been going on (must be a song there) as in when did dossers first call?

      Now are you working, or on benefits remembering low paid workers also can receive benefits like Council Tax Relief. Have you a partner, and children?


      Did the bailiff come in and list goods to "Secure " the debt, this is known as the Walking Posession" or levy? What items did he list? What paperwork did he leave?

      I know there are a lot of questions but are essential for Beagles to see where you are, and how to challenge.

      As to the threat of prison, that is not for Tossendales to decide, as that is left to the council and only used for longstanding wilful NON Payers, you are a can't pay. That threat of itself opens the door for a Formal Complaint at some stage to the counuil CEO, the Leader and your MP.

      Other Beagles will pop in soon have no fear.

      Remamber one thing if nothing else BAILIFFS LIE!, when he com4es back film him/them if mob handed even with a mobile phone to vcapture his threats. He cannot demand you stop filming him, ther is no law that says you can't. the Metropoliatan Police have been told off and paid compensation to photographers who they prevented from filming in public, so filming a bailiff at or in your premises is OK.


      If you phone dossere make sure you record the call, remember what I said above, Bailiffs LIE.

      You will need to ask the council
      How many Liabiliy Orders they hold for you
      What tax years these apply to
      When did they obtain them
      When were they passed to bailiffs.

      Once you have the info post it up on here so Beagles can assist further.

        Give your local council a ring first thing tomorrow morning because ,and I'm sure the guys here will back me up,,the large amounts you are finding to pay the bailiffs WON'T be what the council gets......the bailiffs will pay themselves first and send the few remaining pence to the council.
        Are you 'vulnerable' in any way?
        Sick? Disabled? Young children ? Limited income??

        Ask the council to recall the debts from the bailiff and pay council regularly,,even using their automated payment line

        Others will be along soon

          Sound advice from Inca, if there is any long term illness or disability in your family, that would render you vulnerable as would being on low income and receipt of top up benefits, vulnerable means they shouldn't be using bailiffs to enforce, and they can get kicked by the Ombudsman for ignoring it.

            Rossendales are amongst the more disingenuous civil enforcement companies currently in operation. As Bizzybob has said, bailiffs lie. As such, a bailiff collecting Council Tax has no right or power of entry to your home whatsoever. They cannot enter unless you let them in, but if they use coercion or deceit in order to gain entry, this can affect the legality and validity of any levy they may gain or attempt to gain. It is called Irregular Levy. If they force their way in and have no order signed by a judge or a valid and lawful levy, they are committing a criminal offence and are trespassing, so can be forcibly removed if they fail or refuse to leave when asked to do so.

            One question I would ask is whether the bailiff refused to allow you to set up a payment plan unless you allowed him entry in order to gain a levy and Walking Possession Agreement. If this is the case, there is a possibility any levy and fees attached to this are invalid and unlawful as the bailiff has resorted to deceit as well as having misrepresented their powers. That, alone, gives grounds for a formal complaint to the local authority involved and may, possibly, bring into into question the bailiff's fitness to act as a bailiff.

                    Not only is that a blatant lie - bailiffs cannot gaol anyone - they really ought to know it would be a lie.

                    I'd expect that the latter really states something much less emphatic which keeps them just (but only just) within the law, which you have understandably misread as an apparent declaration that they would cart you off to Newgate in a tumbrel, never more to see the light of day.

                    Which council has employed those rapacious ruffians?

                      Whichever overpaid useless shower of muppets it is, a Formal Complaint regarding the bailiffs apparent right to deny the council of your payments whilst Rossenfails consign you to clink preventing you from paying, which they actually cannot do, should wing it's way to head of Revenues CEO, elected leader and MP

                        i work part time and I recieve working tax and child tax, my partner stays a few nights a week ( we are currently sorting things out).
                        i owe for last years council tax which I have a payment plan with rossendales for £150.00 a month, I was late with a payment and roos endless sent a letter saying they were takin action to send me to prison?
                        this years council tax- I haven't allowed any bailiff into my property iv refused them entry? I payed them £500 a week ago and they demanding the further £600 in a weeks time that was Friday, my partner phoned them to say we would be willing to make regular payments or a smaller amount but they refused and said to tell me they'd be at my home within 12 mins to take my property, I then recieved a txt sayin it's be in 1 hour? Then this mornin I recieved a text sayin they'd b at my home with an enforcement team to remove goods unless I pay the full amount to rossendales as well as extra costs

Being late with a payment does not constitute grounds for committal to prison. Rossendales are misrepresenting their powers and the law and are sailing perilously close to the wind in the legal sense.

To the best of my knowledge and belief, they cannot legitimately refuse any payment and must not set payments at a rate that is not realistically payable by the debtor. it sounds to me as if they are trying to engineer a situation in order to garner fees. Under no circumstances let them in and call the police if they make any attempt to force entry or resort to any form of violence.
