As suggested pay the two visit fees keep the bailiff out, you don't even have to waste exhaled air on them, they have no right of entry as they have not had previous entry to your property, they will huff and puff, but no levy tough if they gat all arsey film them with even a phone to capture their threats which you may well be able to use in a Stage 2 Complaint.

Good morning, it seems my little saga is coming to an end, and thanks to the sound advice given to me on this forum, i now have had the original bill cut by almost £200, and also the council have agreed on a repayment plan that i can afford. My final question, if anyone would be so kind to reply, is that i have been making weekly payments direct to the council, and have paid rossendales their £42.50 fees, the council say i should now start paying the bailiffs direct to clear the debt, do i have to? Or can i carry on paying the council. Any advice as always, much appreciated.

Hi, its now approx £550. At £10 p/w.

Now that the new rules have come in you may have to. Have the Council instructed Rossendales to accept the payment plan they have agreed with you? Reason being is that at £10pw it is going to take 55 weeks to pay off - more than a year. The Liability Order still lies with the Bailiffs to enforce as it is still unpaid, if there is no agreement with them then the Transitional arrangements apply whereby the £42-50 already paid will be classed as the Compliance Fee but they could attend and claim an Enforcement Fee of £235 which will then be added to what you already owe.

In view of this I would contact the Council and ask if they have told the Bailiffs this arrangement is suitable, if so then yes I would make arrangements to pay them instead.

Thanks ploddertom, the council have said that they have told the bailiffs that they are happy with that. On that basis i've emailed the council and the bailiff to set up the repayment with the bailiff. thanks again for the great advice.

Don't forget that if you are late with payment they can say you have broken the arrangement and could then incur the Enforcement Fee. Find out when payments are due and you should ensure that monies rech them in clear funds by that day, essentially this means paying a week in advance and allows for "banking time", where possible set up a Standing Order. If they say they will send everything out to you make sure you chase them up every 2 or 3 days.
