  • Any advice please?

    Good afternoon, could anyone please advice me on what to do. A long story short as poss.Pre xmas first visit from the bailiffs, no entry made/given,there was 3 liability orders,2 dating 2009 for £400 and 1 for 2013 for £370. Second visit was 9th Jan. I actually offered him in, i know,i know! but to be honest i have very,very little and i suppose it shows,because he declinded,handed me the paperwork and said to make an offer, he then walked away.There is no W.P.A. signed or any inventory listed. I filled in the means form and offered to pay what i can realisticly pay which is £5.00 per week. A letter arrived this morning from the bailiffs saying an arrangement has been set up for £32 per week! I can't even pretend i can meet that.so what now, any advice please. Also, can i ask the council to audit my C.T. accounts, i have 4 apparentley,for the same address, because i have reciepts for C.T payments which they dispute and despite 3 requests they will not give me a final bill. I keep getting small bills £50-£70 the last, in august 2013 for 2006! I must stress i am not refusing to pay C.T. but i can't get the council to finalise it all. Any advice really appreciated.     You need to speak to someone at the Council and ask the following questions:
    1 - how many Liability Orders they have against you
    2 - the dates they were obtained
    3 - the addresses they were for
    4 - the period of time each covers
    5 - how much each one was for
    6 - how much is still outstanding
    7 - the dates they were passed on for enforcement
    8 - the dates & amounts of any payments


    You can always pay the Council direct at a level you can afford by using online banking, Council website or automated phone.

    Which council is it?
    Which firm of bailiffs is involved?

                  Hi all, thanks for your replies, i've emailed the head of revenues at the council asking all the questions pointed out in clever clogg's reply plus i've stated to them that the arrangement the bailiffs have come up is not what i suggested or agreed.and is impossible for me to do. I'll post their reply.One final question. the bailiff's first payment is due 2nd feb,do i pay them the £5p/w i offered or email them to say their £32p/w is a non-starter,and wait for the council to respond? Again there is no WTA or levy inventory. Many thanks in advance.

                    Have you noted when the 2nd feb is and they will default you for either paying early or late?

                      There is no law that says you have to speak or deal with the Bailiff. Pay direct to the Council via online banking etc but you may have to budget extra for lawful Bailiff fees.

                        As the bailiffs are Rottendales, it seems more likely than not that their claimed fees will not be exactly lawful.

                        There are three liability orders, so the bailiffs may try to charge 3 x first visit fee, 3 x second visit fee, 3 fees for invented levies of goods (all of which will be the same, vaguely described and probably not owned by the debtor) and 3 x "attendance to remove" fees.

                        After all, we know that this bailiff is just as disingenuous as the rest of his tribe, so let's see what other lies he has told.

                          Just to add they expect the payment on the stated date in "Cleared Funds", so would have to be in their account on the second. To pay with a debit or credit card on the day would be no good as it would take a further three days for the credit to reach the account.

                              Good morning, i've got all 3 distress warrants and his first and second visit fees of £24.50 and £18.00 on one of these.so the bailiff fee is not the problem really, its the fact that i offered £5.00 p/w when i returned the means test. they are saying an arrangement of £32.00 p/w is now in place. I will not and cannot agree to an arrangement i can't possibly keep.There was no inventory listed and no WPA signed so when i don't pay the £32.00 on the 2nd what can the bialiffs do then? i'm still waiting on a reply from the council' they don't rush down here! Thanks again
