      Merely because the troll was too tired or insufficiently strong to tuck your motor-car under his arm and stroll off with it, does not imply that he has abandoned the levy or lifted his seizure of your jalopy.

          Because the bailiff left. I was under the impression this constituted an abandoned levy, from what I read on another site some weeks ago, one which purports to help people who might be 'dealing with bailiffs.' The statement is unequivocal, "The judge said- "If the bailiff levies on goods then leaves the premises without a signed walking-possession agreement is evidence the levy has been abandoned". But when I just now read through the case which is referenced, those words do not appear, and the judgement in the case appears to say the exact opposite. If I may employ the vernacular, WTF?

          So I'd be grateful if someone could clarify what constitutes an abandoned levy. In my case, on querying this with R&R, they claimed, very conveniently, that the bailiff came back to my house in the evening and the car was gone but they heard voices. This is possible, but what bailiff would visit a house without at least ringing the bell or knocking? No way the mrs. didn't hear either of those. I didn't hear from them again until they turned up a month later on 7th November, unexpectedly as I had sent a letter questioning fees to them which was unanswered. (They claimed not to have received it though it was Recorded, trackable, and received.)

          So what constitutes an abandoned levy? And as an aside though a potentially important one, should they have suspended action while they were replying to my letter asking for a breakdown of fees? And I'd really like to take them to task over lying about receiving my letter- this influenced the council to continue with the action and cost me a lot of money.

            In order for an Abandoned Levy to occur, a bailiff must first obtain a lawful levy. The bailiff must then give the debtor a reasonable time in which to pay the debt, usually seven calendar days. However, if the bailiff fails to return after the seven days have expired and remove the goods upon which they have levied, the levy is then considered to have been abandoned.

              Oh, really? Run by an (apparently) ex-pat computer programmer whom some say may have claimed to have been a commercial airline pilot at the age of 15, and whose uncle Walter famously invented the poppeta-ka-poppeta machine (link) written about by James Thurber? :grin:
