Rossendales Bailiff and Council tax advice needed

Hi

I have been an avid reader on these forums the last 2 weeks, as I have an ongoing issue with Rossendales, and a Bailiff called Mr Deplacido.

I owe a council tax bill of £199.09 (I have no dispute about this) so as I being ignorant it wasn't a surprise when a bailiff letter came through my door, but the amount shocked me, I got a bill of £402.59 (this was the first letter I had received off them, so I called the local council who the bill originated from and they confirmed the total amount i owed them was £199.09

So after that i rang Rossendales and was told this matter was with a bailiff and I had to speak to him, He was abrupt to say the least and demanded immediate payment otherwise he was going to take the car he had a Levy on, I then asked him what car as i drive a work van and he had put a levy on my house mates car

So to cut a long story short, I eventually got a bill break down and it is as follows
Council tax bill - £199.09
1st visit Fee - £24.50
2nd visit Fee - £18.50
Levy Fee - £31.00
And then an amount of £130 just stated as (Other)

I called the Bailiff back and asked him what (Other) was and he said it was a van fee to remove goods, But as I understand it isn't that illegal or fraud? to make out he has used a van to remove goods that he doesn't actually have a levy on?

Can someone get back in contact with me soon about this, to just know where i stand, because after reading these forums I am led to believe all the bailiff company can charge is £42.50 for a 1st and 2nd visit

The bailiff is adamant any delay in me paying his ridiculous total will result in more charges added

Hi and welcome to Legal Beagles.

Is your housemate's name on the CT Bill and Liability Order? If so, the levy fee is lawful. The van fee is dodgy in any case.

Unless your housemate's name is also on the liability order, the levy is invalid and so neither the levy fee nor the "other" fee (sic) is payable.

Record all 'phone conversations with that "gent".

His certificate comes up for renewal on 17/09/14 - presumably at Burnley Combined Court, where his current certificate was issued.

What I'd like to know is why, if he is employed by Tossendales, is he also the sole director (and bailiff) of Brosco Limited? (link)

Are there tax advantages in such an arrangement?

Im guessing that he has set up his own company. I have a Bailliff chasing me who I believe has done the same.

It's not unusual for them to do this as it allows them to work "freelance" ifthey get the heave ho or a slack time.

Can they then worked for any company if their own is only mentioned on the register?

Signor Bruno Crispino Deplacido is listed on the Register as working for Rossendales.

The baliff can only charge you for the visits made, so, if what you say that they only left one letter then the charge is £24.50.

They would have to prove they were at you property twice and if they want to charge a levy and a van they must produce the Inventory of items seized.....a front door mat, the ceramic pots in the shed and the rotary airer in the garden won't cut it.

The baliff can only charge you for the visits made, so, if what you say that they only left one letter then the charge is £24.50.

Oddly enough I did levy on a ride-on lawnmower which was left in an open lean-to.....big bugger with 2 24" blades made by John Deer (other manufacturers are available), and clamped it all-in-all, the liability order was for 400 something quid and the machine worth a couple of grand, used! Got paid within the hour.

Got paid within the hour.

Sounds similar to what local authority Parks Departments use. And you're pretty close to what it is worth.

in answer to a few questions

the council tax bill is for an old address, so therefor my current house mate has nothing to do with it, the levy he out on his car (which has now been sold) was is connection with this debt, but the car was in his name?


Iv spoken to the bailiff a few times now and he keeps saying "you need to pay ASAP otherwise I will continue to add money to this debt,

Can someone advise on what I can say to him on the phone or Rossendales themselves to make them realise I am no idiot and I will not be bullied into handing over fraudulent money.. (I have no issue paying the existing debt I owe but I refuse to pay there ridiculous charges!!

In my considered opinion, nothing will do that as the bailiff and his employers are inherently greedy.

You'll have to take up the matter of their charges - and improper levy - with the council, reminding them that they are ultimately responsible for the conduct of the goons, trolls and oafs they have decided to use.
