  • Help Ross & Roberts harrassment

I have council tax arrears that the have a charge on my house for, but Ross and Roberts have visited 4 times to try and set a payment plan. Wanting to come to the house the note items to secure the debt on. I already have a payment plan with them for other council tax which I have paid monthly without fail. I have not let them in, I have spoken to bailiff on the phone once and at the door once.

Now they have written to say I have no payment plan in place at all, when I rang the office I was told it was cancelled in April as I paid it online and not phoned them and done it over the phone. Surely this can't be right????? They have accepted the payment online since April. The bailiff has called since then and confirmed the plan was in place.

So as I have paid the plan every month can they just cancel it but still accept payments. Also surely as there is a certain amount secured on my home can they continue to call to try and get me to secure it on items in my home. They know I am on benefits and my home situation.

today I have returned home to 2 missed calls from the bailiff and a text asking me to get in contact. I sent an email on Monday stating any correspondence needs to be done in writing, but they say the office can't set up a payment plan and I have to see the bailiff.

i am being harassed by them, they call nearly every week and make charges for each visit even though I was told they can only charge for 2 visits, is this right???

help I suffer from severe depression and this is tipping me over the edge.

Does the local authority involved know about your health issues and that you are on benefits? If not, they need to be told asap. You may need to obtain a letter from your GP to confirm your health issues. It sounds very much that you are considered to be vulnerable under the National Standards for Enforcement Agents which most local authorities and bailiff companies have signed and agreed to abide by. However, it is not enshrined in law and compliance with the Standards appears to be variable.

Ross and Roberts will take no notice, I know of a woman who had a walk in possession done on her when 8 month pregnant.....and that is visible!
The Black rat (Rattus rattus) is a common (hence the accusation of being Pleb) long-tailed rodent of the genus Rattus (rats) in the subfamily Murinae (murine rodents). The species originated in tropical Asia and spread through the Near East in Roman times (another thing that we ought to thanks the Romans for, besides roads, aqueducts and public toilets) before reaching Europe by the 1st century and spreading with Europeans across the world.

A mutation of the beast now comes black leather clad, riding a motorcycle that looks like a battenbergh cake on wheels.

A skilled predator, totally ruthless with it's prey, but also known to be extremely generous in doling out tickes that can provide points for motorists who want to downsize from mechanically propelled vehicles to bycicles.

It's a dirty job, but someone got to do it!

Easy Sir Vere, people cannot be levied, unless they belong to a gangmaster.

The vulnerability and proof of it must be provided to council and bailiffs, but as the bailiffs are Ross 'n Robbers, I fear that the council may well have a Crapita infestation, as in Capita run the councils office, and they happen to own Ross 'n Robbers.so if the vulnerability is ignored, a complaint yo CEO and Elected Leader copied to MP may be required

I am puzzled as to how the council have a charge on your house for non-payment of Council Tax. I've not heard of this before, are you sure that is what they have?

Ignore Sir Vere's comment, it is most unhelpful and makes a sweeping generalisation it is impossible to make.

If you have not missed any payments under a repayment plan, the bailiffs should be leaving you alone TBH, and letting you pay as arranged. However, if you are late by even one day it is normal to cancel the plan. Has this happened?

Re the vulnerability, as said above, as long as it can be evidenced, they should (and are expected to) give at least make allowances for your condition and treat you sensitively, and quite possibly hand the debt back to the council.

Yes Chaz, this is fairly big news at the moment. The LA's are too quick to use bailiffs when a repayment could be reached. This was the case with me. I was happy to and could pay, just needed a little extra time. No chance, so four LO's against me and sent to the bailiffs. They still didn't get their money any faster as I didn't have it to pay.

                  Dear Sir Vere,

In these unfortunate days of punitive estate taxes, & the historical abomination of releasing serfs from the (rightful) servitude of the landowners, coupled with the fact that the family fortune was probably squandered by a long-dead relative down at the Hellfire Club, I am led to believe that certain more motivated members of the aristocracy have been forced into having to take up a day job.

Should this be so in your case, may I humbly ask what this job may entail?

Also, should it prove (annoyingly so) that this might lead to a conflict of interests when posting comments, may I suggest (though I realise that it is not my place to do so, so please don't take offence) that a suitable indication is added to your signature?

Finally, Sir Vere, I am fully cognizant as regards Feudal Land Tenure & fiefdom, so should you sound a call to arms, I assure you I will be ready, pitchfork in hand!

                  Fore-lock-tuggingly, cloth cap doffingly yours,

                  A Serf

                    Brilliant!

Surely you are not hinting that Sir Vere may be a hundreder or oversee a bailiwick? Heaven forbid this should not be declared, though the fall from Lord of the Manor must be a hard burden to bear.

Sir Vere can be certain that my Longbow and Crossbow are available with myself if there is a general call to arms. No bailiff shall cross the line, if their levy is vexatious or invalid in any way.

In the days of Queen Margaret (patron saint of thatchers) the first, I was a Sargeant at arms in the distinguished body of HIGHWAY PATROL of Royal Norfolk, being a real norfolking good subject (if I may say so myself) when close to the twilight of my years, after protecting and serving HM subjects from the likes of Richard Turpin for one score year and four, I was appointed to HM Courts as a Warrant Officer and Sheriff, until the dreadful day that these services were tendered out to less noble men than myself....thus my interest in bailiff issues.

An excellent reply Sir Vere, and much as you were abused when first you came here, I, for one, welcome your input (even if I despise rogue bailiffs and bailiff companies, which covers all of them I think). Hearing it from the horse's mouth is always good. Don't feel obliged to answer this, but for which company did you work?

Sir Vere, our main issue is not with the worthy Sheriffs and warrant Officers of the court properly appointed (of course the Sheriffs Office is bundled with the privateers and pirates) but is with the privateers and wastrels amongst the certificated bailiffs.

Never worked for a Company, I was seconded to HMCTS Norfolk by Norfolk Constabulary, but when the job of serving Distress and Arrainment Warrants was passed to the "Private" sector I was offered a Job by Drakes, which I did not take as suddendly fishing for great white sharks using my left foot as bait sounded much more appealing.

I am still convinced that when a "proper" Constable knocks at one's door at 6am asking simple questions like...have you forgotten to pay for this fine? You have two option now, you either find the money withing 7 days or you get a free ride in my mobile "battenberg"....most often than not the right result was achieved....which was the recovery of the money.
