  • Ross and Roberts Bailiff Query

    I have joined this site because I had a rather terrifying phone call this evening from a Mr. Vertessy. I received a letter this morning from a debt collection company called Ross&Roberts, their address is in Torquay.
    The letter was obscure and because there is so much illegal activity these days I was unsure if it was valid so rang the number on the letter.
    They confirmed it was concerning a parking fine I incurred in the South Hams district.
    I had in fact been in dispute over a ticket I received at a Tavistock car park. I had, because of torrential rain causing impaired vision, misread the charges and mistakenly paid for a 2 hour space but as if I was a commercial vehicle. If I had been a commercial vehicle, when I got back to my car I was still within my time. But because I was a car, I was over the time by 10 minutes. I tried to explain that a fine of £25 was over the top for such a mistake and if I had been a minibus they were actually owing me money! Needless to say, they behaved like rockweillers and would not discuss anything. It was horrible and terribly unreasonable. I since revisited the car park to check the sign and it is indeed a little vague. I even took photos and submitted them but no go.
    So, time has gone on and today I get THE LETTER. Ross&Roberts gave me a mobile number and the name Mr Vertessy and told me I have to speak to him. I tried ringing, but no answer, He eventually rang back and was so rude and aggressive and completely refusing to negotiate when I explained my circumstances and offered to pay monthly installments. He threatened he would come to my address and take my car! I am a woman on my own currently temporarily having to stay with my elderly mother. I was so worried I came home and googled his name. I couldn't believe it when his name came up instantly and it appears he may have been acting illegally a couple of years ago and threatening people if they didn't part with money that was three or four times over the fine they should have had. Is this company legitimate, is this Mr Vertessy ok and is it possible for me to pay my fine in affordable monthly installments?

    Did you have any knowledge of the original PCN and subsequent notices from the Council?

      Tavistock comes under the jurisdiction of West Devon Borough Council, whose head office is in Tavistock. South Hams District Council has their head office in Totnes. As for Mr Vertessy, he is based in Plymouth and his behaviour is apparently known to the local plods. Making unwarranted demands and using menaces (threats) as a means of enforcing them is a criminal offence and carries a substantial custodial penalty. Vertessy needs to have this drilled into his head if he tries this again, otherwise, the only place he will be heading is custody.

        No. The letter I received from Ross&Roberts yesterday morning (Friday 21st) was the first I knew the fine had escalated to bailiffs being involved. I had moved house though, back in early January but had my post collected for the first 3 months and had nothing in the post then.

          Thank you for this feedback. I have found a couple of rather damning pieces of info on Mr Vertessy which only heightened my alarm. I have planned to call in at the local police station just to find out what their thoughts are and at the very least, hopefully log my concerns about this character.

            If you can divert them from munching doughnuts for long enough, they'll probably misinform you that "it's a civil matter; ain't nuffink we can do" or even tell you some utter nonsense about it being a crime not to let the oaf take such of your goods as he might please.

            That's what one might expect from a police force apparently recruited from unsuccessful applicants to McDonalds.

                The said "gentleman" does not seem to appear on the bailiff Register. Are his "credentials" in current good order?

                  If you have Vertessy's first name, could you PM it to me, please? I can then check with the Enforcement Section at Plymouth County Court tomorrow as to whether he is currently certificated.

                    I don't have it. Searching under his surname produces no results. Have also searched through all R&R and none appear to match.

                        Sounds like Vertessy got a taste of his own medicine and didn't like it, so he lied and exaggerated to the plods. No wonder Capita/Equita/Ross & Roberts lost their contract! Lol!

                          Who took the contract over? Is Vertessy acting as a debt collector only and is claiming bailiff powers as he does not appear to be Certificated?. One thing is certain, the public at large would be much safer if Vertessy was certified rather than certificated, and held in a secure mental health unit.

                            It is possible that he is still employed by the Capita/Equita/Ross & Roberts triumverate as I believe South Hams District Council use them.

                            I have just been watching a video on YouTube and a retired police sergeant - Dave Eden - is speaking to Brian Gerrish from UK Column.                               Most interesting, hopefully sales of immodium, and other continence aids will increase when the Crapita group gaffers realise they will be up in front of a judge along with their criminal bailiffs, and the council officials and even elected members who appointed them.
