    Many thanks for your input on this Fair Parking. Fortunately for the OP he still has his car as payment was made in full, subsequently Newlyn found one of their rare errors about duplicate fees and are in the process of refunding some monies but as we all know there do appear to be others that they have overcharged for.

          We seem to concentrating on unlawful fees rather than the fact that there is no warrant and thus fighting the wrong battle in the wrong field.

            ALL I have seen written down is that a warrant has been issued by the TEC. Okay, but I am now in the situation where I have payed. And trying to claim back...Can I ask for proof of a warrant? If they cannot provide what options do I have then? Police?

            This has now created another avenue and some confusion for the best route to take..

              I'm pleased that my points appear to have been confirmed, although I'd like to see what Milo has to post - there may be an entirely new direction to take.

                    Yes, that letter is much what I'd have sent to Newlyns, except that I would have further disputed that any of the fees they had offered to repay could have arisen from fees merely being duplicated.

                    Expect flim-flam if they bother to respond.

                      update:

                      After the letter was sent explaining the unlawful charges as per responses from Cleverclogs & Ploddertom, I have now received the following back.

                      Dear Mr XXXX

                      Thank you for your correspondence, the contents of which have been noted.

                      Please be advised that investigation into your complaint is ongoing and we will respond to you again with a resolution as soon as possible.

                      Yours Sincerely

                      Newlyn PLC




                      Now there has been no mention of the time scale as to when they will respond properly...

                      Any ideas as to what to do next?

                        It's worth keeping the council fully informed of what you are doing, as if they issued the ticket, and instructed bailiffs, they will be vicariously liable. I'd be inclined to copy them in on your complaint and the response (either to the CEO or the Head of Revenues).
