    No Inca, we always suggest the OP makes payments directly to the council. There is a very good reason for this, which is why I asked the questions I did in the post previous to yours. If he's been making payments direct to the council, there is a fair chance we get get them to call off the bailiffs. :tinysmile_grin_t:

      I understand all that BB,,but referring to post#21,,I read that as the stacking payments should be made to Rossendales and NOT the council which is why Rossendales are kicking off again? Or am I completely mis reading things??

        Rossendales will be kicking off again because they've been told to. The OP is right to have been making payments to the council, and may hopefully be able to get Rossendales off their backs once and for all now. There's never any guarantees of how people react in this life, but fingers crossed .......:tinysmile_twink_t2:

          its the same three letters from them i have fully cleard one of the liabilty orders and the council have confirmed this but rossendales are still using that account reference number
          the other two relate to the same one i dont know eaxctly what remains but i have paid about £600 i have written to the council again last night quoting the new guide line with a quote from 4.5 which says that they can recall the debt at anytime i also ask for the outstanding ammount to be confirmed and the ammount paid to date
          do i have to fill in any forms from rossendales by law ? or is that more lies ?
          and there was a mention of court action due to non payment is this possible

          good to be back on here just wish it was under better circumstances

            and not recived anything from council since june which is when i asked them for a third time to recall the debt
            no post either
            outstanding ammount was 1300 ish but i will confirm it

                    There is a possibility of a court date for council tax arrears - has this threat come from the council or from Rossendales? Rossendales can't take you to court, nor do you have to deal with them for anything whatsoever to do with Council Tax. By not dealing with them, you keep your liability to them down to £42.40 as long as they don't gain a levy against anything.

                    Have you ever completed an Income and Expenditure form to send voluntarily to the council? This would show you are paying all you can reasonably afford to pay from the arrears. Any judge looking at this would do just that - look at your means and ask whether or not you are paying what you can? If you are, the chances are, in my opinion, he would ask the Council (as Rossendales can't take you to court) why they are wasting his time.

                    The fact is, you are repaying it. The council likes all arrears cleared within the tax year (by March 31st) and this has clearly not happened. This is why it is probably a good idea to show them concrete evidence that you are repaying as much as you can.

                      the threat was from rossendales along with their cost and expenditure sheet i have not had anything from the council this has been going on for well over year now and i am going to increse the payments in the new year now i have a stable job at last

                        Unless a court has directed the OP to make payments directly to Rossendales, which it would appear a court has not, and as long as the OP is making regular payments to the local authority to clear any CT arrears that may exist, in my opinion, Rossendales are in no position, legal or otherwise, to be making the sort of statements they are making. In order to prove "refusal to pay", they would have to produce evidence that the OP had told them and the local authority they were not paying. In the absence of such evidence, Rossendales are likely to stitch up the local authority if the matter does go to court. due to vicarious liability. However, it does make me wonder whether some form of mandatory order needs to be made in order to curb Rossendales' habit of thinking they can make threats they cannot legally make or statements they cannot substantiate.

                        Yet another reason to close down the civil enforcement industry.

                          Marstondales ( Marstons bought up dossers earlier this year) are obviously on a maximise fees by frighteners, on debts passed to them but being paid to the council directly, if the council or dossers tried a non payment court date they would be on a very sticky wicket. I am with BB on this Distress as a remedy should be abolished, and the bailiffs closed down.
