  • can some one look at this please rossendales again

thank you for your email received below and previous regarding your refusal to come to an arrangement to Rossendales Bailiffs Ltd and request for details of the outstanding balance.
As requested, the outstanding balance, excluding any fees LEGALLY incurred by Rossendales, is £955.34. Please see my responses below regarding your further queries:

    1. I can confirm that there are two liability orders payable by you for the above address
    2. The liability orders were obtained on 6 October 2011 and 15 June 2012
    3. Both relate to (the address)
    4. Liability order 6 October 2011 relates to the period 1 July 2011 to 31 March 2012 and the liability order 15 June 2012 originally related to the period 1 April 2012 to 31 March 2013 but due to vacation of the property was amended to the period 1 April 2012 to 30 June 2012
    5. The liability order 6 October 2011 was obtained for a balance of £906.33 and the liability order obtained 15 June 2012 was for £1,185.07
    6. A balance of £706.33 remains payable on the liability order 6 October 2011 and £249.01 against liability order 15 June 2012. I would advise that the difference in the balance for the 15 June 2012 liability order is, in part, due to the balance being reduced due to your vacation of the address on 30 June 2012
    7. The liability order date 6 October 2011 was initially passed to Rossendales on 10 October 2011 but was returned for a trace of your current address to be made and was re-sent to Rossendales on 23 January 2013. The liability order 15 June 2012was initially passed on 19 June 2012, again, this was returned for a trace to be actioned and re-sent on 23 January 2013

also what is my next step please this is all getting confusing ! also i have never seen a bailif or a made up van and i have never seen any levy paperwork i just dont answer the door

I suspect looking at the above you would have been asked to send Letter 1 from here as well:

    http://www.legalbeagles.info/forums/...Useful-Letters

Have you had a reply to that yet?

If the above was in response to a letter to your council, as I suspect, it is somewhat ill-mannered.

I assume you have already had a visit from the Bailiffs? Can you tell us how that went etc?

Re: can some one look at this please rossendales again

If you haven't been visited by bailiffs you owe only what the council has told you at present. If it is still with the bailiffs, they may charge for two visits (£24.50 and £18.00 if you live in England, slightly less in Wales) and as long as they never gain a levy on anything, that is all they will be able to charge.

If you are confident you can keep them from attaining a levy, then pay the council what you can afford online or via their automated telephone system.

Following the new guidance yesterday, you should be able to see any FREE debt adviser who should be able to help negotiate an acceptable and sensible repayment plan for you, thus negating the need for the council to use the bailiffs at all.

If your housemate is no longer resident, do the council know this? Also, were they resident during the period covered by any Liability Order? If not, the council may have to go back to court and have the LO amended to reflect this. Whether this would affect Rossendales position is another matter. If the council have to have the Lo amended, Rossendales will need to exercise caution, although they all too frequently take the view that it doesn't apply to them. They are that arrogant and stupid.

Report this to the council immediately! If they have provided a copy of the LO to Rossendales and there is evidence Rossendales have tampered with it, it needs to be said that tampering with an official document is a criminal offence! Remember what I said about Rossendales being arrogant and stupid? Add "corrupt" to that.

Can I suggest you send copies of the above, pointing out the date on both is the same, and send them together with Letter 4 from here:

                      http://www.legalbeagles.info/forums/...Useful-Letters

Send to the Head of Revenues copied to your local Councillor.

Keep making regular weekly payments as you have been directly to the Council. Could you work out how long it will take you to repay the full debt at the rate you are paying please.

Also keep the bailiffs away and don't let them get a levy on anything. If there is only you in the house now, have you applied for a single persons discount?

Re: can some one look at this please rossendales again

sorry to sound daft but how is the date relevent ? i have only been paying £10 per week so it would take ages to clear it but i am more than happy to increse it if i can deal with the council direct. i am now living in a different property and claim the discount
what i would like is for me to be left alone to pay council and bailiffs to hassle ex house mate

                        regards Ian

can they do what i have circled in black ? letter 4 requires a breakdown from them which i dont have yet is there any way it could be re-worded ?

once again just my name on it

                          regards Ian

You're better waiting till you get the breakdown - there is reasoning behind it, trust me. Once you get the breakdown, send it to the Head of Revenues with Letter 4. The date is important as they are not allowed to do as they have in charging certain fees on the same day. If the Head of Revenues condones this, which they usually do, it is a BIG stick to use to get the council to take it back as long as you can prove you've been paying what you can. You say you could pay more. If you could do this comfortably and sustain it long term, then you should do so to clear the debt.

Could you clarify something, please, Ian? Is the LO actually dated 6 June 2013? If not, the documents are suspect. Have you seen a valid copy of the LO? It is a legal requirement that the bailiff provides you with a copy of the LO on his/her first visit. If this has not been done, Rossendales' demands and fees are highly suspect.
