    Hello there everyone, Another of my little queries.
    As those of you who are kind enough to read my posts know I have several outstanding laibility orders for Ct .
    'The first two these are secured by levies on a vehicle, which has bereen scrapped. On the third there is no levy.

    At the moment I am paying £125 per month to cover these and paying the council £80 forthis years CT.

    The bailiff ccompany are saying that they cannot enter into an arragement for the third LO as they do not have a levy . B ailliff turns up every two weeks and shoves a notice of removal through the door . They cant levt my current cars one is on Hp and the other is a blue badge holders vehicle. Anyway the valu of both is little more than a thousand pounds, even if sold privately.

    My main question is does the code of practice for enforcement agents require them to come to an arrangement without a levy ? Am I correct in assuming that the only lawful charges they can make on the third LO is one first and one second visit fee.

    If they are telling you the onbly way they will accept an arrangement to pay is by levying on goods then you must make a Formal Complaint to the Council. Not only is there no Rule or Regulation it is also increasing your debt. In my view tell them to get stuffed and start paying the Council direct instead because I bet you've already paid a load of fees.

              Here's the draft I am planningto send to the head of revenues. Then I'll CC to my local councillors there are three in my ward . and to my MP. Comments on the letter appreciated .


              Formal Complaint






              Dear head of revenues,
              I wish to make a formal complaint about the actions of your appointed agents Jacobs. They are currently collecting for a liability order no 123456 . A bailiff has called several times and unsuccessfully attempted to levy . I have made several offers of a payment plan based on my limited income . Each time this has been refused and with each subsequent visit the amount outstanding has allegedly increased . There are two other liability orders which I am paying . The total monthly amount is £XXX .As far as I am aware there is no legislation or regulation that requires the collection agent to secure the debt and therefore they have no reason to continue to call .

              I would remind you that I am the registered carer for my wife; who is is an insulin dependant diabetic. Her severe neuropathy means she has to regularly use opiates for the pain and has extremely restricted mobility and does not answer the door . The calls and the letters are causing her severe distress and affecting the management of her condition .


              In the light of this I would respectfully request that the case is withdrawn from the bailiff company and returned to the council .

                Don't really see a lot wrong with that. I would suggest that contact with your Councillors is made initially by phone even if just to advise you are sending them a letter. As for your claim on vulnerability you will have to back this up with some form of proof.

                    I have to say, I wouldn't bother sending anything at all. As Ploddertom said earlier, I'd ignore the bailiffs completely and just pay the council directly. Once you've built up a reasonable payment history, then we can look at getting them to call off the wolves.

                    I would send Letter 1 from the link below to ascertain any genuine bailiff costs which may be applied to your account.

                    I'd also get an accurate balance from the council of your balance, as you may well find that previous bailiff fees have been removed from any payment made to them before sending it to the council. This is absolutely correct IF the charge itself is correct.
