    Video footage, provided it is in unedited form, is very damning and cannot be argued with. Even if there are grounds for arguing, a legal professional would have an uphill battle trying to convince a judge a bailiff's unlawful/illegal actions, on the video footage for all to see, were lawful.

      my legal advisor says that if you believe that the other person might be involved incriminal activity then they do not needto be informed of the recording . but that a judge would have to rule on admissabitlity.

        That is correct. You would also have to explain to the judge why you recorded any conversation covertly, i.e. without telling the other person, in order for the judge to determine admissibility.
