  • Parking Charge Notice - Help Needed

I currently live in merseyside and I was told to visit bury market, which we did it is around any hour or so's drive , we parked in a car park which we now know was called DW Sports Bury car park, we drove in parked and then walked over to a pay and display machine bought a ticket, and displayed it in the car, we arrived at 10.51 and left at 12.28, we have now received a PARKING CHARGE NOTICE, for £85 or £50 if we pay before 14/3/13. Stating that the car park we parked in was in fact a 30 minute free parking zone and after i spoke to Bury council it seams we had bought a ticket for the adjacent council car park, we were completely unaware that they were separate car parks as there is only a paved walk way that separates them, this was a genuine mistake. But people have advised me to ignore the letters even when they start getting nasty, but i don't want and CCJ' s on me,,,, PLEASE HELP:-) If it was a local car park then I could go and asses it and then put an appeal together but as its such a distance away I can't

    Re: Parking eye .

You should do one of two things:

    1. Ignore entirely - you'll get a series of about 5 or 6 letters, each more threatening, then they will stop.

    2. Appeal to POPLA and then, if your appeal fails (as is likely), then ignore as per one. The advantage of this one is that it costs the Private Parking Company £32.40 which they have to pay within 30 days. As more and more people are doing this, the PPC's are beginning to feel the pinch and before long, it is likely some will go out of business altogether.

The 'ticket' is nothing more than a speculative invoice.

It was sent by Parking Eye car park management, the top of the letter say Parking Charge Notice.

I am just So so so confused, I don't want to pay it, but I have also been told that they may hand it over to a bailiff, and the thought of that just makes me ill. :-(

To hand it to a bailiff they must first gain a CCJ which you then don't pay, Parking Eye have been spanked in court when trying to enforce one of their unlawful civil contractural penalties, in court before, they can sue on consequential loss only
If the parking fee for staying beyond the 30 minutes was zero, then their claim must fail, if it was £2 per hour, the loss is less than two quid, so again to demand £85 is a penalty, which is unlawful under the law of Contract that governs these PPC parasites, for further info, go to peppipoo, and the MSE parking forum, where you can read all about these parasitic muppets Parking Eye. Ignore them unless they send court papers.

They will send a series of increasingly strident letters full of ifs buts and maybes, none with any purpose than to scare you in to paying them, any mention of responsibility of RK to pay is a bluff, they are trying to enforce a contractural penalty, which is unlawful as it is disproportionate to their actual loss, the burden of proof is the civil test on the balance of probabilities, not the criminal beyond a reasonable doubt, PE MUST first gain a CCJ, before a bailiff can call, they may say "doorstep collector" will call etc in a threatOgram, again you can ignore them ,are a debt collector no powers. Eventually when they realise you are not taken in by their bluster they will move on to a more compliant victim, they rarely do court, usually they need you to try their bogus appeal, process, and engage in correspondence with them before they may try court.

Actually, it would be better for you to appeal against it to POPLA, which will cost you nothing and which will cost the parking parasites about £37. When the appeal is lost, you can then ignore it until and unless they actually take you to court, which is unlikely.

If they did try to sue you and you defended the case, they would probably lose.

Especially as no doorstep collector has ever been known to collect doorsteps.

                            Precicely

They may however have collected a knuckle sandwich when trying to prise the doorstep out.

Personally i would ignore the muppets, as to engage with them in any way encourages them into thinking they have a catch, but in the end it's your call
