Escalate the matter to the HMCTS RCM (Regional Contracts Manager) if the HMCTS AEM (Area Enforcement Manager) is behaving like a muppet. The next step after the RCM is one of the Heads of Enforcement Operations at HMCTS. That, however, is a last resort.

I don't think i spoke to the AEM is was just some lady who told me they can't do anything now the matter has passed to Marstons, as they sent me a letter (which i never received, why don't they send these things signed for? They are of high priority are they not?). Do i call the Magistrates and then ask for Area Enforcement Officer?

Also, is an enforcement officer the same as a bailiff? As the guy isn't on the register.

Sorry to update this again. I just spoke to them again, she said she is going to get the AEM to call me.

But she said there will be nothing they can do, as they sent me four letters last year including a summons. Which i never got, i never received any of the letters, i wouldn't have ignored a Court Summons! Especially over a £60 speeding fine.

You need to ask the exact address on the Warrant including postcode they have used. Not be the first time it has gone astray, the fact the bailiff has visited is of no consequence as they will have used other methods for tracing the correct address.

They've got the correct address, she read it out to me. I've lived here my whole life. But i have 100% never received any previous contact, otherwise i would've paid the £90 the moment i realised they didn't receive my cheque.

But obviously they're going to say it's a bit fishy, we sent you four letters and you received none. But then again, they have no proof that i received the letters, i still don't understand why courts don't send mail that carries such significance, recorded. I'm sure i could dispute whether the letters even left their premises etc, this could just go round in circles.

I agree with what you say. All they have is a letter on a screen which has a date, they will then say it went to the post room and sent out. If it was you sending to them they would entertain nothing unless you could at least provide a Certificate of Posting.

I've just spoken to the Area Enforcement Manager, and she is saying the same thing. That they sent me 3 letters, and now that the warrant is with Marstons they can't do anything about it. And i have no choice but to pay Marstons £390.

How can i take this further? Regional Enforcement Manager? Surely they will give me the exact same answer.

Also, another thing i am confused about is when i speak to the court they say there is nothing they can do. But when i speak to the Enforcement officer he tells me he will await further instruction from the court...

I thought that speeding fines are issued by police. Also, to my knowledge, the magistrates court will not endorse the license until the fee has been paid (that happened to me about 5 years ago).

The RCM is your next step. They can kick the backsides of the AEM and Marstons. If it reaches Head of Enforcement Operations level, those below them are going to have some very searching questions to answer.

I thought that speeding fines are issued by police. Also, to my knowledge, the magistrates court will not endorse the license until the fee has been paid (that happened to me about 5 years ago).

It's not the magistrates that endorse the license.

The RCM is your next step. They can kick the backsides of the AEM and Marstons. If it reaches Head of Enforcement Operations level, those below them are going to have some very searching questions to answer.

Ring the court and ask for the name and office telephone number of the HMCTS Regional Contracts Manager for your area. If the court try to fob you off or refuse to co-operate, come back onto this thread as matters may need to be escalated further and higher.

In the mean time, i just heard back from the Baliff/Enforcement Office and he said as follows:

"The Warrants office have requested that we apply for an arrest warrant due to continued non payment. At this stage i have stalled my report but it would seem that you are going to have difficulty in putting a valid appeal and i will need to return for further enforcement by the end of tomorrow if not paid in full. You may be better to appeal after payment rather than risk further costs and enforcement"

That sounds like 24-carat bovine excrement to me. Is the matter subject to an appeal? If so, enforcement should not be taking place. Be prepared to escalate this matter to a higher authority within HMCTS if necessary. Hopefully, that may not happen, but be prepared all the same.

As far as i'm aware i cannot appeal the matter, according to the court now it has gone to Marstons there is nothing i can do.

The point stands, if they cannot prove i received the letters i.e. sent the letters signed for and have my signatures, they cannot say i received them correct? Like it was stated earlier, had i said that i sent them a letter in response to theirs a year ago, they would be saying they didn't receive it and i have no proof i sent them a letter...

Should i just pay the total fee and dispute it afterwards? I really don't want to get arrested!
