    Whether or not he was telling lies - and it's hardly commonplace for a bailiff to speak the truth - I believe the matter should be escalated as, if the tale were true, someone would have falsely reported that Crotalid had refused to pay the fine.

      As stated, contact the Warrant Office at the court first thing tomorrow morning and check out what the bailiff has said, then ask for the name and office telephone number of the HMCTS Regional Contracts Manager for your area. If the court staff and bailiff are being economical with the actualities, HMCTS senior management can nip it in the bud. The RCM is one step above the AEM. Usually, RCMs can and do sort such things out, but be prepared to escalate matters higher than the RCM.

        Thanks! I will do as stated above tomorrow morning, 9 am. Hopefully it can be sorted, if not i will report back here with the reply they have given me.

        Thanks, are bailiffs and enforcement officers the same thing? Do they appear on the same register? As mine doesn't appear on there either.

        Like you say, I've never refused to pay the fine. If they asked me to pay the £90 i would've, and would do so tomorrow!

          The point stands, if they cannot prove i received the letters i.e. sent the letters signed for and have my signatures, they cannot say i received them correct? Like it was stated earlier, had i said that i sent them a letter in response to theirs a year ago, they would be saying they didn't receive it and i have no proof i sent them a letter...
          It doesn't work that way. Unless you can prove that a letter did not arrive (which would be almost impossible) a letter is deemed to have arrived two working days after posting for first class post and four working days after posting for second class post.

          It will be immediately obvious that the bewigged buffoons who thought that up, had long since ceased to live in the real world.

          Should i just pay the total fee and dispute it afterwards? I really don't want to get arrested!

            Really? That's ridiculous, seeing as it's noted all over the internet how many letters are lost, or delivered late etc. On that same notion, i could easily say i sent a letter to them with regards to their letter a year and half ago asking for more details on why I'm being fined (as i thought i sent a cheque). But they would want solid proof i sent a letter, i.e tracking number.

              There is a very strong suspicion, Crotalid, and I would not be surprised if there was substance to it, that court staff put an entry on their computer system that letters, etc., have been sent, but they have not, in fact, been physically posted. This is getting a bit too commonplace. Also, as Clever Clogs as posted, Marstons have form for telling the courts people are refusing to pay or avoiding paying fines when, in fact, Marstons are doing everything to prevent people paying the fines.

              Escalate this to the RCM first, then, if necessary, we will help you escalate it higher.

                Marstons need to be pulled up short and comtracts removed, there are too many instances of their bailiffs defrauding debtors, and obstructing payment, not to mention assault on debtors and innocent parties.

                  But the problem is not confined to Marstons - the problem is endemic throughout distress enforcement.

                        Hi, and update...

                        I spoke to RCM, and he said that he has no power to do anything and my only option is the pay the Bailiff, that they sent me the letters, and there is nothing i can do if i didn't receive them.

                        What do i do now?

                        This is ridiculous.
