Unpaid pcn - newlyns baliffs nw inolved

    After a stress free Xmas and New Year, thanks for advice all....

    Update...


    TE7 / TE9 forms were submitted, and duly refused, have got a letter from court dated 4th Jan...

    Medway council also submitted a statement of truth and a copy was forwarded to my ex (old address).

    My ex has informed me Medway council have on their records confirmation that she applied for housing benefit as of the 29th June. The initial contravention was dated 29th April. Letters were sent out on the 9th May. 14th June, and 26th June..

    Obviously, during the months of May/ June we were going through our issues and in June, she applied for housing benefit. I care to add 6/7 months down the line this is still not resolved and I have been doing the right thing and paying this, whilst being fortunate having a very good friend who puts me up. Hence not really wanting to stump up the excessive fees being charged by Newlyns.

    I guess next thing is to do is to complete the N244 form, stating I wasn't living there and didn't receive letters etc.... what chance have i of this being taken into consideration? (is there a guide to completing this form?)

    Is is worth contacting Medway direct to see if I can pay them ?

        thank you for the link...

        The fees being charged by Newlyns, are they correct or is there way to get those reduced ? Earlier replies stated once I has these, some kind person may be able to look at them?

        To date I have not instigated a formal complaint to OFT, regarding the earlier communication, in lieu if the fees were also incorrect I could add this to it also.

          I'm struggling with these fees - maybe Ploddertom could shed some light on any mistake I may be making?

          This is what I've got:

          PCN £97.00
          Letter £11.20
          Visit 1 £ 28.00
          Total so far £136.20
          Visit 2 £ 38.14
          Total so far £174.34
          Visit 3 £ 48.81
          Total £223.15
          VAT@20% £ 44.63
          Total £267.78

          I can find nothing in the legislation which talks about an Enforcement Fee. By their calculations and charges, the rate of VAT charged is just under 15%. Clearly they are wrong somewhere. I'm not saying mine are 100% accurate, and would appreciate someone checking them, but theirs are clearly inaccurate.

            On each visit they claim to have made did they leave any letters or other paperwork?

              To date, i have had only two pieces of correspondence from them ,

              1 - A straightforward bailiff removal letter, handwritten, with no costs, just named address and their ref no. not dated,
              2- A further baliif removal letter, this time computer generated with a total outstanding amount and a date. (19/11/2012) .

              Then after asking, after requesting information re their charges, a letter dated 4th December 2012.

                Been back to my old area to pickup a recorded delivery letter, held at the post office, from Medway Council, alerting me to the fact the case has been passed back to Newlyns.

                By chance has I now need to negotiate with these people, has anyone analysed their charges? Labman kindly did look over them already, but has anyone else?

                    I have emailed Medway Council on numerous occasions before, during, and after the witness declaration. Each time I have been told that it has been passed to collection agency, Newlyns, or as its with TEC they cannot deal with it.

                    Each time I have asked for them to use their discretion, each time they have just shrugged it off. At no time have I said I wouldn't pay what is owed to them.

                      Going back to post 19 where I tried to make sense of some charges for you, I'd be inclined to send a copy of my calculations to the Head of Revenues, a copy of their charges to the Head of Revenues and ask him to explain any discrepancies between the two.

                      I would also ask, in the same letter, if he will accept the £267.78 in Full and Final settlement of this matter.

                      By doing this, he is put on the spot. He either can explain discrepancies, in which case we can scrutinise his reasons, or he can't, in which case my calculations are correct.

                      If he condones incorrect fees, then we have a very clear next step.

                              looking through Medway Council, they do a good job of hiding their personnel. Have found a guy, Chief Finance Officer.. is it worth sending this email to him ??
