    Re: A joke

I have not heard back from the Court yet. The High Court Enforcement Officers Association have sent me a complaints form which i will do. HCC have tried to distance themselves from the muppet who started this. The company who started it are happy to take my money but not take the debt back but I think they have been shafted by the enforcement people who kept back £620 out of a £1000 paid towards their debt.Surely the fees cannot be that high, legally? I want to write back and tell them that they have been ripped off. Still struggling along.

      Hi Patchie,

Have you done anything about sorting out your letters yet? If not, say so as I've an idea. At least then we can move this forward for you rather than it be hanging over you as a worry.

Just a yes I've done something, or no, I can't face it is fine. I'll make contact with you then.

        Re: A joke

I have started. Should there be letters explaining they are coming or are they allowed just to turn up and be a pain? If they have to send a letter I haven't found one.

          Hi Patchie,

It's not bailiff stuff we're looking for in the letters, it's letters from the court re the CCJ so we know what to do next. There should be something there from them - if there isn't, then you can apply for it to be set aside.

                Re: A joke

I have a letter from a solicitors dated April 27th 201 PDT Solicitors in Southampton supposedly instructed by Hilton Baird. I have nothing else until the judgement - though I have little more stuff to go through I have cleared everything since March so nothing else has cropped up.

                  Re: A joke

I have had another visit at my shop by HCC. Said it was a courtesy call and am I OK. Told him not really. He then came out and said we had an agreement and I owed them money. Told him that i was not paying them anything as the behaviour of his colleague was outrageous and that I was awaiting correspondence from the Court and the OFT based on his colleagues behaviour. He left a sheet of paper and left quite quickly.
Is there any way i can stop these clowns coming around and ruining a perfectly good day? I am prepared to pay the originator the money I owe. This bunch seemed to have stuck another £200 on the debt. I have found all the paperwork from the originator to the original people to the court. What do i do now?
Oh, yes the first thing I get is that he is from the Sherriff's Office. What the heck does that mean?
It doesn't take much to pull someone back down again.

So why are they coming from HCC or has this moved again to another company?

                        Re: A joke

OK Patchie. They are trying to enforce a CCJ against your company, yes?

When you shut the company down by dissolving it or liquidating it, this debt will be written off. They cannot come after you personally for a company debt as long as you have no assets of the company at your house. This is one reason we're encouraging you to get this done!

                          Re: A joke

So if I move whatever I have left out of my house or store it on someone else's property they can't touch me? I only have a few weeks left if that in the shop.

Thats about it, close the business down, move the stuff out of the shop, store it in the garage if you have to, and hand the keys back, then breathe.

If they have genuine reason to believe it is on someone's property they can enter the premises I believe (PLODDER???????)

If there's nothing re business assets at your house, they can't lawfully touch you. The CCJ is in the name of the business I assume. Ideally dispose of all the business assets asap.
