        About your vulnerability issues. As you may have gathered already you cannot depend on the Bailiff to do the right thing he is only driven by one thing and that is to screw you for as much cash as he can. He doesn't care about your situation, your finances, your health or those of anyone close to you. Far better to send the same letter to the Council as well, so there can then be no doubt about your circumstances. As BB has said all enforcement companies & Councils are signed up to the National Standards and are supposed to abide by them.

        Sometimes the usual response from them is to claim the Standards are guidelines only and not law. In other words they want to pick and choose the bits they want. You do then have the Benefit of the moral high ground and many Councils & Bailiffs have been made to look stupid when MP's and the like have to get involved.

          i know allmost nothing about baliff law so i am shooting from the hip

          if you consider yourself to be included in the category of a vulnarable person, is it not the correct procedure to inform the local authority and not the baliffs. baliffs will just show contempt to your request. it is the councils job to recall the liability order from the baliffs. if not, and your are a vulnarable person and the council did nothing, the council would be held to account under vicarious liability

            Hi but want people usually find is that the council are one sided and will almost back the bailiff company in most cases and peoples problems fall on deaf ears as the council don't know what the law is.
            Before sending Humpty Dumpty bailiffs out,the council should take time to see what situation a family or person is...im sure it will save them lots of paperwork,time and money.
            I will be writing to my local M.P and get him involved. thanks

              Unfortunately, Sanj, councils, all too often, leave that to their brain-dead enforcement contractors who see the National Standards for Enforcement Agents as an inconvenience which is there to be conveniently ignored. I have no doubt there will be protestations to the contrary from bailiff companies, but the reality is that certificated bailiffs all too frequently ignore the Standards and, in doing so, cause real harm to real people. It will require a change in the law or the police being repeatedly kicked up their backsides to change the situation. Whether people badgering these new Police & Crime Commissioners will have any effect has yet to be seen.

                The Council employ the Bailiffs on a no cost basis. The Bailiff does all the legwork and the Council reap the rewards.

                        If the local authority has cocked-up, the debtor cannot be held liable for any expense the enforcement contractor may incur as a result of such errors and the enforcement contractor should not seek to recover such costs from a debtor in such circumstances. Reimbursement of expenses is the responsibility of the local authority in such cases.

                          If this is for Council Tax ...there is no provision for you to be charged a 'letter fee' at all?

                              Thanks great advise ,so do still pay S/G £5 per week,basically speaking i owe them nothing and should have no business with them as they levy s are unlawful.
                              Should i therefore may payment direct to the council?

                                Pay the Council direct (at the rate you have been doing) with regard to any outstanding Council Tax...then you need to challenge the bailiff fees with both Council and the bailiff company ..see bb's post #26
