    UPDATE: The identity of the scrote is now known and the court that certificated him. It is also known that what was written on the Final Demand the scrote had with him was false. He claimed he had an arrest warrant. Doubtful. The injuries have now been confirmed as two fractures in the right foot - meaning the scrote's actions amount to GBH and, possibly, Burglary, as it is still to be established if he had a right to enter the lady's house. The lady is due to return to hospital next week for a scan on her injured foot to check for ligament and nerve damage. It is quite possible that DVLA has seriously messed-up, as the fine that the scrote was supposedly enforcing was struck-out by HMCTS Thames Valley and the case dismissed on the strength of a Statutory Declaration by the lady's son, who has not lived with her for at least nine years.

    More updates to follow when available.

      hope he gets what is coming to him it is about time marstons had the book thrown at them, and that poor excuse of a human being placed in a position where he is bullied and harrassed by scrotes himself, I would volunteer in an instant.

            as I was talking about a while back about marstons how in 2009 when I first put my old house up for sale a numptie from marstons who got it all wrong (had no bailiff issues) decided to call our estate agents to get information stating to them the thaught the house was empty which was a down and out lie as my hubby was home at the time with heavy rock playing while decorating, so windows open a cat sitting on the window ledge and me in the garden de weeding our estate agants called us and told us that he was trying to lie to them to cause aggro. called em was called abusive by thier call center agent (apparently not allowed to be angry) got bailiff details called him and gave him what for and told him if he ever came to the house again that he would become an instant eunoch with a blunt razorblade. he never ever called and we heard nothing.

                    Many thanks for your kind offer Anon E Muss. The more people who know and sign the petition, the sooner the Ministry of Justice will get the message that using private bailiff companies to enforce unpaid fines is the wrong way to go about enforcement. Fully-accountable HMCTS Enforcement Officers and police officers are the only ones who should be allowed to enforce unpaid fines.

                        Ermmm thinking about that I wonder what would happen if they forced entry into my house? should I just let the dogs do their worse? I mean they would've heard them barking as they always do so they are obviously aware of them and what if the bailiffs get bitten ( laughs)ohhhh that made me smile but on a serious note would they have to get a police dog handler or something? any suggestions?

                          No. The police should not do anything to assist private bailiffs. However, you MUST clearly display a sign outside your home warning visitors of the presence of dogs. You should also send a written notice to the bailiffs warning them that you have dogs at your home and that in the event they force entry or attempt to force entry to your home without lawful authority, namely, a court order, they do so entirely at their own risk and that you will not be responsible if they get bitten. A suggested letter to the bailiffs could be worded thus -

                          Acme Bailiff Co.
                          xxxxxxxxxxxxxxx
                          xxxxxxxxxxxxxxx
                          xxxxxxxxxxxxxxx

                          Dear Sirs,

                          Reference: xxxxxxxxxxxxxxxx

                          Your bailiffs have, on previous occasions, threatened to force entry to my home. I have yet to see any evidence that they have a right in law to do so and neither have your bailiffs produced a court order to me authorising them to force entry.

                          Your company and its bailiffs are put on notice that I own two dogs, who will, as any dog will do, defend their territory against intruders and protect its its owners, against any form of attack.

                          Your company and its bailiffs are further put on notice that , in the event any forcible entry is attempted to my home without lawful authority, that is, without an order signed by a judge and sealed by a court being in force, such unlawful entry is entirely at the risk of the bailiff or bailiffs concerned.

                          This notice is hereby deemed to have been received and served. No further notice will be given.

                          Yours faithfully,

                          I would suggest this is sent by Signed For Mail and addressed to the CEO of the bailiff company involved. As long as you give them fair and adequate warning, the bailiffs and their employers would find it difficult to mount either a civil or criminal action. As for a notice outside your home, a notice worded "BEWARE OF THE DOGS" should be adequate. Put one at the front and back gate, if you have one, and one by the front and back door. Again, that is fair and adequate notice.

                              Unless the scrote has an order signed by a judge, he will not be attending with any locksmith. Locksmiths who are members of the Master Locksmiths Association will not break any locks without first having seen that the person requesting them to do so has lawful authority to enter the premises and to require the locksmith to help them gain entry. The other thing is that the police will also be in attendance in order to prevent a breach of the peace. If I remember correctly, I have advised you to send a written notice to the bailiff about your guard dogs and to put notices outside your home warning of the presence of the dogs. If the bailiff wants to behave like a prat, let him. All I would ask is that you video your dogs sinking their teeth into his backside and post it on this thread. Lol! Only joking.
