    I don't know about you, Davy, but the arguments Legalese is putting forward strike me as being very much "Freeman On The Land" arguments. There are some aspects of the Freeman philosophy that are worthy of further investigation and once these arguments are grounded, it may be that they can be used to turn the tide against those who abuse and misuse the law. Until those arguments are grounded, I am inclined to view Freeman arguments as "as yet unproven". It is not me being a cynic, just me going by gut-feeling.

      No he doesn't have the power to enforce a warrant only a court bailiff has (it will have the crown on it).
      If a policeman issues you a fine and you accept it and you fail to pay it then yes they can come after you as you accepted it, only a judge can give you a fine not a policeman, however, he can attempt to give you a penalty charge for breaking the rules.
      Democracy is a great word isn't it.
      The books are based upon our law and are available for us all at £7000.00 + lol

      I am not encouraging anyone to play about with the law but when you get bailiffs that come along and use scaremongering for profits then yes you should use the law to its full extent and fight back.

        Yes i don't like intimidation and i think even the hardest of persons would feel intimidated, but like Legalese states, if you haven't knowledge on the law then the whole process with the bailiffs is intimidating....

        Tomorrow is D day for me when the line manager in parking fine office is getting back to me with regards to how we're going forward with this situation, either paying the fine at original cost or its going back into the bailiffs hands :-(.... so please keep fingers crossed for me!!

        I do appreciate everyones advice and sorry not been on here much but riddled with a cold!!

        Yes fingers crossed, i apologize perhaps i had the wrong impression i thought a woman alone, a young child = vulnerable, perhaps i am just showing my age, young woman are a mach for any beefy bailiff these days, in any case you sound like you are. Good luck.

              @Legalese if the council will put the fine back at the beginning and willing to prove the fine exists as i was caught on camera then im sorry i'm happy to pay the £55 and bring all this to an end, however if this is put back in the hands of the bailiff then i will sling anything at them for them to go away,apart from my money...

              @Davyb.... yes im a single mum of a young daughter,and a son with mobility issues so if i can thow the word VULNERABLE at the bailiff then i shall sing that word from the top window in the theme of romeo but VULNERABLE VULNERABLE I AM SO VULNERABLE!!! , would that work???? :-)

              I'm happy to be the guinea pig with LEGALESE's theories aslong as its legal in the sense i'm not carted off in handcuffs,

                  Warrants of execution are issued by county courts, warrants are as you say issued to court bailiff i also mentioned orders (as in liability orders), the fact is that bailiffs enforce orders and warrants.

                  Not sure what you mean about the fine thing, it can be regarded as admitting the offence if the fine is paid on site, if that is what you mean, and if a defense is made the hearing would be in court the decision made by a judge.
                  If you are suggesting that the driver is better off going to court if guilty of the offence , i would certainly not agree, as the fine is going to be magnified significantly by the process.

                    As you can read i'm ignorant to the law.....

                    Can the bailiff get a warrant from the court with a crown stamp to come into my property if i'm not home and all windows are locked!!!

                    I'm currently trying to train my 12 week old kitten to attack if they do but she just looks at me and purrs!!!! :-/ lol

                            MLC we will end it there but remember that you asked the council to send you the evidence for you to pay the fine and in doing so you actually agreed to pay (contract established), however, they refused to accept your payment. Now davyb will advise you further on this refusal to accept payment.

                              How does asking for evidence of a debt establish a contract,that is even if having a contract was even relevant in this instance.
