until you get a reply to all the questions in post#2 you are stumbling in the dark..... for now concentrate on the amount alleged owed to the Council £881.65...you have paid £700 to that and would expect to owe the balance £181.65 to satisfy the LO...the debt is not a priority and the rate of repayment should be one that is affordable to you, pay the same amount each week/fortnight/month on the same day/date.


It is important we get to see exactly what is listed on his levy to determine if it can be seen as valid or simply made to garner himself a bit of beer money...His van fee is a load of rubbish, the levy fee is on the wire to being legitimate depending on what he has listed on the notice of seizure and it could be the only fees due to him are 1st & 2nd visit fees total £42.50 which you can also pay to the Council and leave him to ask them for payment of them.

They have replied to my emails giving me a breakdown of the costs incurred and the notice of seizure.

Please find attached a statement of your account for your perusal.

Details of each visit where fee’s have been charged are as follows:

07/02/12 the bailiff attended at 6.24pm with the instruction to levy on goods, no contact or levy was made, fee charged for this visit was £24.50. The bailiff who attended was Mr Lee Green and was certificated in Worcester County Court on the 22/09/11.

22/03/12 the bailiff attended at 12.40pm with the instruction to levy on goods. The bailiff was allowed peaceable access to the property and levied on goods, the charge for the levy was £43.00, the Walking Possession was signed and the charge for this is £12.00, the redemption fee is £24.50. The bailiff who attended was Mr David Bailey and was certificated in Worcester County Court on the 17/05/10, this expired on the 16/05/12 and was renewed on the 17/05/12.

17/07/12 the bailiff attended at 3.13pm with the instruction to collect payment in full or to remove goods for sale at public auction, for this a Van/Abortive removal fee of £180.00 was charged. The bailiff who attended was Mr. Samuel Gould and was certificated in Worcester County Court on the 24/11/11.

Having reviewed the account we can confirm that all fee’s have been charged correctly and in accordance with The Council Tax (Administration & Enforcement) Regulations 1992 (as amended), an explanation of the fee’s can be located on the Notice of Seizure of Goods left with you on the 22/03/12, however we have attached the schedule of fee’s for your perusal.

Your current balance is £525.00, this must be received in our offices by 6pm today 30/08/12 to prevent further recovery action being taken against you.

pc.............hard drive removed to protect personal info....value at auction £50
panasonic hifi....... unless top of the range.. worthless at auction
shelving block.....if yours needs to be solid oak at least....or it will be worthless at auction....

..if guitar is yours what make and condition is it in? what did you pay for it? possibly worthless at auction.

What date did you move out of the property? have you got the info we suggested you get from the Council?

The guitar is worth less than £20, especially since its been broken for a while. None of the furniture on the list was mine; it was all supplied by the rented accomodation. I'm no longer living at that address as I've now graduated from University.

The PC has been given to a friend. And the panasonic hifi has been thrown away.

We moved out of the property in June '12.

I'm yet to obtain the council information

Looking at the dates given can you tell me if any payment arrangement was made following the levy & were any payments made between 22/03/12 & 17/07/12? If there was no payment arrangement or you did not make any payments how many times did the Bailiff visit in the same period of time?

Followng the bailiff visit a payment arrangement was made. Unfortunately, although I made a payment every month from then, it wasn't in accordance with the arrangement (Gas/electricity bills were a lot higher than expected!)

In my opinion, the levy was improper or invalid, as not only would the items listed would not have realised enough at sale to cover the alleged debt, it included items that did not belong to the alleged debtor.

(I used the adjective "alleged" as there may be some doubt over whether the liability order should have been made.)

Moreover, the purported levy gave the names of three people, two of whom would have had nothing whatever to do with the alleged debt even if they'd engaged in a gay Mormon wedding with the third.

Succinctly, it is crap and no fees should be payable for such slip-shod work.

Does Bollocks and Sh-i-thead know where you currently reside?

although barely legible, that says 19 pounds by 1/4 which I did, and then 3 payments of £210 at the end of each month, which I didn't due to a change in financial circumstances. I'm pretty sure I called them up to explain I needed to change the payment plan but they refused and demanded I pay it all off instantly to abstain from further charges.

CleverClogs - They don't know where I currently reside, but I was under the impression that this type of information would be easily obtainable by bailiffs??

A question to add on here,if you have moved and a bailiff turns up asking for you by name and you say your not that person what can they do after all they have no legal powers to demand proof of who you are and would the same apply if a doorstep collector turned up on your doorstep having traced you to a new adress,
i for one would be interested in the answer might be helpful to others

You don't have to answer any questions they ask. You do if it is a police officer. Doorstep collectors have absolutely no powers in law whatsoever. Inserting the toe of your boot into their backsides and seeing how far they fly through the air before landing on a hard concrete path or pavement is a very satisfying pastime I believe. I understand that Arse-Kicking may be included in the next Olympic Games in Rio de Janerio, in 2016, if not, the ones after that, in 2020.

Thanks bluebottle just as i thought but great to see it in writing might be useful advice for those facing visits from bailiffs and others i would love to see the look on the idiots face and hear the reply does anyone reading posts on here have experience of doing this to outwit a bailiff

The only time you might have problems is with unpaid court fines. I am currently dealing with an incident near to where I live involving one of Marstons' thugs allegedly enforcing an unpaid court fine. You are better dealing with the court direct in cases like that. Ignore any BS from the court staff of "You have to deal with the bailiff." You do not. However, if it is an HMCTS Warrant Officer accompanied by a hairy-arsed copper at your door, chasing an unpaid court fine, I wouldn't argue or try to pull the wool over their eyes. They will have done their homework before they came out to see you and will take you in if you play silly buggers with them.
