  • Equita Bailiff Charges!?

    Hi there,

    This is a first for me, so bare with.
    I have two outstanding PCN for my vehicle. I know it sounds bad, but i had a death in my family and wasnt thinking straight for awhile. I contacted equita to arrange a payment plan which was fine.... i started to pay, but then missed a couple of payments. I have now received a letter stating REMOVAL NOTICE. Of course i called them to pay it off, but the baliff then adivised me that one fine is now £342.68 and the other £355.30 = £697.98. When i said OMG, and questioned the amounts, the baliff couldnt tell me what the charges were or how they had come to that amount?? He said if i paid the 1st that he would send the 2nd amount back to Equita for a payment plan to be put in place....I cant afford £342.68 for an amount that was outstanding for £75. Noone has been to my property yet as i have til tom to pay, vehicle still here which i still pay for monthly so im just wondering how the charges got so high??
    Please could you advise me on what to do. I am going to pay the Baliff £100 tomorrow, just to get a little time on my side, well if he accepts that???? Please help. many, many thanks

    Hi Tiffmalik and welcome to LB.

    It sounds very much to me that Equita have been adding fees they are not legally entitled to charge. They are already being investigated by Trading Standards over this. The clue is in what the bailiff has told you, that is, that he doesn't know how they had come to that amount. I would not offer Equita anything until they provide you with a breakdown of the fees. I would also move your car well away from your house so the scrotes cannot levy on or seize it. They wouldn't be able to anyway because you have indicated it is subject to some sort of finance, but move it all the same because bailiffs lie.

    It would be wise to email Equita tonight and send them a Recorded Delivery letter requesting a breakdown of fees first thing tomorrow morning. You need to copy Letter No.1 on the following link www.legalbeagles.info/forums/showthread.php?34062-Useful-Letters

      hi, many thanks for that.

      yes, can email and send a letter, no problem. Im just a bit scared of having Baliffs @ my door etc. Can move the car well away too. even though the car is reg to me, it's my father that pays for it..., but if ever need be i can get paperwork to show that its the bank that actually owns the car! All the assistance you can give me would be great....i just want to sort the problem...i know it's my own stupid fault, but the charges are just a joke...

        Hi, Have noticed on letters that there is no email/web address....Will send a letter recorded fist thing tomorrow....What do i tell the Baliff when he calls me tomorrow?

          Also, i have read that if you live in a flat and the baliffs gain entrance into the main door that they can force entry into you home whether you're there or not! Is this the case or just abit of wrong info. i'm just scared that when i come home one day my interior will be gone

            I can't add anymore to the excellent advice of BB......if the bailiff reappears close your ears to the waffle he will spin you, there is no law that says you have yo speak or deal with a bailiff...from an upstair window just politely tell him you have called his fees into question and will not be doing any negotiating with him until you get satisfactory answers to the questions you have raised. Do not let him/her intimidate you and certainly do not let them in.

              An upstairs flat...even better, no he cannot break in at any time unless he has a warrant from the court...and trust me they don't give those out like you would sweeties. Entry has to be inside your actual dwelling not the buiding the dwelling is in.

                Thanks...Touch wood i havent seen him at all yet...just had telephone conversations with him. To be honest he's not been rude (well not yet) Just very pushy when asking for payment to be made tom. I did tell him yesterday that i really cant afford that kind of money and that i felt uneasy paying for something i really cant justify.....he just said "see what you can come up with by Mon" and hung up....


                cant wait to get it all sorted....stressful

                          Hi again... I emailed a letter and sent recorded asking for a breakdown of fees....Mr Nichol called me today to ask why i havent called and paid him. I stated to him what i had done and that i was awaiting a reply. He got a little cross saying that he would be at my property tomorrow to remove goods. I still havent been given a break down of fees and the fact that he is visiting means that my bill will be even higher!

                          What should i do..... this is awful

                          Any help as always im vry thankful for.

                            Hi, Mr Nichol, the baliff has just called me back to state that there is another letter in the post for me posted today and to call him back tomorrow when i get it! He wont state what it will say and just hung up on me I hoping it's a statement of fees

                            I will be on again tomorrow to update of the situation. I have also put a sign in my car window stating that the car is on finance!!

                              To claim your car is on finance you should send copies to the Bailiffs, you should also copy in the Council and ask that it be placed on your file in case of query.
