    If the breeder has used your stud to one of her queens then to register the litter she mist have your signature to prove that your cat was used. (presuming the cat is registered to you)
    If she doesnt have the signature these kittens are not registerable therefore the breeder will make a loss. Have you spoke to the breeder and said that you will not sign the paperwork unless they drop this?
    Also threaten them with informing the GCCF (assuming again the cat is registered and on the active register) and any breed clubs they are associated with.

    I am no good with legalaties but what i do know is about Dogs/Cats and breeding and showing.

      hi. the stud cats was a straight swap and we both signed ownership over that day. she took a week to send her paperwork off to the cat club putting him in her name. she had 5 girls ready and was using the cat that afternoon. now if the cat was ill why would she then a week later transfer him into her own name, surely if she was bringing him back she wouldnt have bothered to do this. she still has him. she said he was unwell with a poorly tummy so i said bring him back and my vet will see him, she refused at this time. a week later she said ok i will bring him back but only if i pay petrol again which i refused to do. this has been going on for 4 months now and instead of a swap back she now wants nearly £2,000 for what i dont know.

          You need to find out what the money 2000 is for. If it is for vets bills then you need to see the notes from the vet to say it was most likely due to you that the illness was caused. This is VERY hard to prove if the breeder didnt take the cat directly to the vet for a check up.
          Having worked in rescue i know this to be true after taking emaciated dogs to the vet 1 or 2 dogs after receiving them they just wont put their name to any possible court claims that they were wrong in their assessment.
          I would still tell the breeder you will be notifying the GCCF and any breed clubs she is registered to. It all sounds dubious if she is willing to use a poorly cat as a stud.
          It does not sound in any way an ethical breeder. And i cant see how they have brought this to the bailiffs.
          The money cant be for the kitten and if they are saying it was then where is the contract to prove this? And if its for vets bills you want to know what the cat was treated for and why he was not returned to you instead.

            thankyou monzter. i feel this breeder had all the intentions of using my boy as a free stud otherwise she would have given him back way before now. all such a worry. i dont really care if bailiffs take my things as its a way of clearing the house out but not animals this is just cruel to take them away. xx

              Also regarding the cat being taken by the bailiffs. Pedigree or not it is worthless with no papers. They will only take what they can make money on. How will they make money on a cat that they cant prove is not a normal moggy?
              Also politely inform them that along with being a moggy (they will find it hard to prove without papers and microchip numbers and possible DNA) that it also suffers with a heart defect that costs over 300 per month to medicate, do you still want my expensive to keep moggy mr bailiff??

                she did take the cat to the vet 4 days later saying he had a poorly tummy and fleas, this is why the breeder contacted the rspca. rspca went away happy, no fleas at my home. i agreed to have him back and she refused, then a week later after her queens wasnt in season she wanted to bring him back and swap back. i told her i will have my boy back but go to the original plan and buy her boy. she put the price from £700 to £800 then to £1,000. when i said not £1,000 she is taking the mickey she then went to moneyclaim online and put in a claim. i had already spoken to my vet after he spoke to hers. the only vet bill is for booster vaccination which she agreed to pay as she was desperate to get my boy home and use him. he had a healthy check 4 months before going and was healthy. he hasnt had any medical treatment for over a year since i had him so her claiming he is now on medication for what i dont know, the vets havent said anything about this its just her. so apart from booster vaccination of £22 agreed beforehand and the price of buying a stud does not come to £2,000. she wont give me a breakdown. my vet thinks that as you pay for a limit this is how she gets her claim figure. oh yes bailiffs are back again, quick urgent question are they allowed to climb over the fence as my cat is in the outside pen..... have to go quick they are trying to get in the gate which is locked. x

                  thankyou for the help. bailiffs have just gone. i gave them a copy of the judgement set aside form and a copy of the posting to the court. he said he will do a walking possession to save coming back again later, i told him not before a judge has read my defence. if im wrong and a judge says so then i hold my hands up and do what im told, until then they can leave me alone. he will be back.

                    just read the posts. there isnt a contract as it was a straight swap. gccf wont get involved as they say i dont own the cat its in her name which she done a week after visiting the vet. the breeders website does say she has kittens due april but this maybe too late to prove its my boy. the vet medical history she has just says booster vaccination and blood testing negative.

                      you need to find out what the 2k is for.

                      They cant just state that amount and say your liable for it. If its for vets fees they instructed the vet to do the work they signed so they pay the bill

                          thankyou. the claim amount is not vet fees. i can only guess its £800 to buy the studboy and £22 for booster jab. i have no idea and she wont tell me. when i can put my defence in if im allowed with set aside judgement i have my counterclaim ready for stud fees which amounts to £1750. works both ways. with the bailiffs i dont know what company they are from, they just said court bailiffs collecting ccj payment.

                                is there anyway i can find out if a vet medical history is from the vets. ive looked at the vet report and it states..... cat has fleas, cannot possible have been from clients home as they use frontline. also it states.... exact words..... the names cat has not been introduced to our clients cats at home.
                                how would they know what she does at home, all they have is what shes told them. entries are strange at time 0.00 we spoke to owner asking if she wanted blood panelling done, owner said maybe. time 0.57 blood panelling was done that we spoke about yesterday. none of this makes sense to me. with this case ive purely gone by what my vet told me after he spoke to her vet, he said just change of diet caused upset tummy, he is fine. ive also looked at emails she has sent to court... states cannot rehome or use the boy... then email to me... what i was thinking is to keep him and you replace him with a queen. does anybody else find this strange. to be clear ive just started breeding and she has been breeding for 8 years. i think ive just been conned.
