This is not my point ,we all know that bailiffs are lying cheating *******s.

You asked for detail re Drakes. It was the Whistleblower program that started their demise and John Marston stepped in buying them out. From memory saving the MOJ a lot of grief.

Attached to this post is a paper I have written for LB entitled "When Bailiffs Turn Bad". It should give LB members a better idea of what offences certificated bailiffs commit under the Criminal Law when they engage in the misconduct that is all too prevalent on this and other consumer forums.

With regard to the extract Peter has kindly posted up, the beauty of Section 17, Theft Act 1968 is that once the police have established an offence has been committed, it is not unusual for other law enforcement agencies (LEAs) to descend upon the company and its management team. These include, but are not restricted to HMRC (Corporate Investigation and VAT Investigation Sections), Insolvency Service (Companies Investigation Branch), Serious Fraud Office (if it's serious enough to warrant their involvement) and OFT (part of the BIS).

Please note that the Insolvency Service can, in certain circumstances, investigate companies that are still trading.

Tell us how and when you have used these methods to obtain an effect, we are all ears.

These are not negative comments these are attempts to get something useful out of your posts.

You want to change attitudes and alter the way the system works, great, will this actually help the OP at this point though.

If they take you at face value and quote some of your rhetoric do you think it will do any good?

Peter - Company law is clear that directors and owners of a company are ultimately liable for insuring their accounts are upto date and accurate. They are also liable for the actions of their employees, workers, or subcontracted parties acting on behalf of the company. This is company law peter, there is no if's or but's about it. If an employee has committed an act of fraud whilst representing the company it is deem that the act was committed by the company. The company has to distance itself by taking action against the employee and compensating the person defrauded to deflect liability. Such as Disciplining the employee (likely resulting in dismissal) and reporting the matter to the police themselves. That way the company can not be held liable. But if they do not take such action they they would likely be deemed liable for the employees actions.

we have just had a telephone call from the head of revenues and he has told me that he has taken back the debt and all fees to rossendales been wavered all future payments to be paid directly to the council.
no mention of investigation of rossendales actions or the Bailiffs involved so i guess rossendales will just move on to their next victim well i hope their next victim has access to this forum !!!!!!!!!!!

we have just had a telephone call from the head of revenues and he has told me that he has taken back the debt and all fees to rossendales been wavered all future payments to be paid directly to the council.
no mention of investigation of rossendales actions or the Bailiffs involved so i guess rossendales will just move on to their next victim well i hope their next victim has access to this forum !!!!!!!!!!!

Hi, I too have received a notice of enforcement.

Originally I received this in November, called the bailiff who was in fact very helpful. I was confused and didn't believe I owed the money, he agreed that he thought the council had made a mistake.

I have now been passed onto someone else who is far from helpful and he's given me 24 hours to contact the council to establish whether I owe this or not. If I do he requires payment immediately. I do not have £860 available. He then informed me he would seize my goods then.

I am going to contact the council tomorrow and in the event of this being owed, originally it was £550, they have added £320 fees what action should I take. I', concerned that my daughter lets herself in from school before I get home, she's 14.

Any advice would be gratefully received.

Don't know how all this works. Hope someone can advise me. Got 3 council tax liability orders through my door today total value of around 1600 from Rossendales.! What do I do next. Have hardly any disposable income as it is sson my own. Feeling slightly scared. Anyone any suggestions please

You will be better starting your own thread and explaining all you can such as how much each one is for, what letters you have had from Council & Bailiffs, what fees have been charged - if listed, the more you can say the better the advice can be.
