      I cant, my main man was killed and thrown away i was wondering if a pork chop would get you to take his place

      As for seperate liability order, would it be easy for them to get it? I am not as worried but my other half is scared and i just dont want her to get worried.

        I doubt it, as they'd have to prove to a court that you were liable to pay their costs.

          As I think you will have guessed by now, Mohmmad, certificated bailiffs are lying, cheating scumbags and should be treated with the contempt they truly deserve. The bailiff who put the note through your letterbox has probably hung himself and Marstons under Sections 2(1) and 12, Fraud Act 2006. Check with the court as to the date they sent notification that the fine had been paid in full to Marstons, then write to Marstons, informing them of this. Also, remind them of the rules governing the collection of court fines by certificated bailiffs and that it is an offence, under Section 2(1), Fraud Act 2006, for the bailiff to fraudulently misrepresent fees due and for Marstons, the company, and its management, to allow such offences to be committed in the name of the company. Also mention that it is an arrestable offence under Section 24, Police & Criminal Evidence Act 1984. You may get a vitriolic reply, but Marstons know what the law says and, in any case, ignorance of the law is neither an defence or an excuse.

            Thanks alot i was only worried cause of my other half as the bailiff knocked on the door at 7am and she is suffering with depression and got diagnosed with sleep apnea today and with all the medical problems i dont want her to have mental problems as well otherwise if its only about me than i am willing to take them to court if i have to as there is no way i am willing to pay them cause i have paid my fine and dont owe them a single penny

              One quick way of stopping these prats is to use Section 3, Protection from Harassment Act 1997. You can apply for an ex parte order (an Interim Injunction without giving notice to the bailiff and his employers) to your local County Court. Shortly after this, you will need to apply to a Circuit Judge to have the injunction made permanent.

              At the time of applying for the Interim Injunction, you should make an application for damages - anxiety caused, financial losses suffered, etc. - and an order for costs against the bailiff and his employer. Should also seek an order for costs against the bailiff and his employers when you apply to have the injunction made permanent.

              If the bailiff and his employers breached either injunction, the maximum penalty they would risk is an unlimited fine, up to five years imprisonment or both.

                They are also in breach of their own Code of Conduct, the National Standards for Enforcement Agents. Personally, I'd just write to them, copying in my MP, Councillor and Court Manager stating the fine has been paid, your wife falls into the category of vulnerable and this is exacerbating her illness and further action will be seen as harassment unless they can produce a valid Warrant of Execution.

                If they can, you need to get a stay on this, resolve the issue while stayed and then address compensation.

                  I have just got off the phone speaking to someone at court. The last time when i called them i was told that the fine was paid in full and i have to deal with the bailiffs. Now today they said that the last £50 might have gone towards bailiffs, now why is it that they saying two different things as i only wanted a confirmation letter from them that my fine was paid in full.
                  Another thing is that i tried speaking to the court where my case was held and asked if i could get the notes or anything from my case file about what happened in the court room but they are unable to provide me that. I was told by megistrate to call a number if i cant pay the fine on time and i called them but they saying that they have the record of me calling them but no record that they said that i can start paying my fine in december(i wasnt calling them to have a chit chat or to makes friends). To me its seems like they are changing there statements everywhere as there is no record and can they change the notes on the system?

                    Another thing i just remember, i mentioned to the lady on the phone that i am a carer for my disabled son and my wife who suffers with depression and was diagnosed with sleep apnea yesterday and i am unemployed to which she said that i dont fall in the category of vulnerable person.

                          Do u mean citizen advice bureau? and does anyone know the email address of them, i know i have sent them 3 emails and the email address is in those posts as well but is it the right email address? is there anyway i can take this back to the same judge or my local megistrate court? sorry guys and thanks alot for the help.

                            No, Mohmmad. Law Centres and Citizen Advice Bureaux have no connection with each other. Law Centres employ legal professionals where you can obtain free legal advice on a wide range of issues. Put the name of your local area followed by "Law Centre" into Google or a similar search engine. They are probably going to be the ones to be able to advise you on the legal issues you have most recently raised.

                                I tried finding them but seems like they are a bit far from my place so ill try to see them when i can in the mean time ill give marston a hard time and wait till they send two bailiffs rather than one than ill just blow myself POOOF and two bailiffs are gone but the shame of it is i can only do it once wonder if i should get a fatwa for that ainkiller: On the serious note i am gonna hold tight and stick to the ground that i have paid the full fine as i have got the last receipt and i have got no contract with the bailiff which enables me to pay them and as long as i have paid my fine i dont think even the police can do anything.
