    I hope this isn't too long winded and makes sense.

    I had a parking tickets last year, forgot about it (my bad), ended up in the hands of rossendales.
    I returned home at the end of may and there was a letter that they had attended amount outstanding £216.30.
    I sent a cheque by return for the full amount. the cheque cleared on the 13/6/11 - have cheques stubs banks statements etc

    returned home tonight ( 3 months later) and there was another that they had re-attended demanding a further £232.32.
    I spoke to the baliff who claims to have attended several times and says he will continue to do so daily
    - I am out of the house at work from 8am to 7pm so am never likely to be here.

    his claim being that the cheque must have arrived & been clearing at rossendales, he wasn't informed of this and which time there must have been another attendance,
    incurring extra fees which are now being pursued and are accruing

    having explained all this, and that I had had paid in full he told me he will still be back on monday regardless and increase the fees yet again
    and that there is nothing I can do about it as he has a warrant to do so and that there is nothing I can do legally to change that until i pay him the money

    what can I do as my blood pressure is now through the roof

    To put it bluntly, he's **** out of luck.

    You've paid. If he chooses to visit again because his records are not up to date, tough.

      you'd think so wouldn't you!

      but they ain't gonna go away. they maintain that there were additional fees (of which I was never informed) and they are now pursuing these!

      S what do you need to get, to get them to cease and desist? back to the original court? solicitor to apply for some sort of 'bugger off' order?

        If they want to try and collect more money from you then they must supply you with the evidence of the alleged visits and evidence of the work they claimed to have undertaken between you paying and cheque clearing, which they won't do because they didn't make any.

        They see you as a cash cow because you paid what they requested last time, without checking their fees.

        It's up to you but if you ignore them there is nothing at all they can do.

          off to have a read... you are a gentlemen and a scholar (with nice legs!)

          ignoring them is an option, but on principle if I can do anything to be a right royal pain in their hint end I will.

          I did discover the Form $ complaint thingy and have a fair list of things to stick on it already - wether that ever achieves anything or not I have no idea

            Well, first off you will need to find out if the bailiff is certificated and you can find how to do that here Bailiff Guide - Legal Beagles Consumer Forum

            You should not file a Form 4 without at least giving them the opportunity to rectify the situation and as above, he needs to be certificated.

            I would imagine the quickest route to becoming a right royal pain is to let them know that you know what you're doing and that they cannot bully any more money out of you.

            Of course, if you really wanted to play hard ball, then you send a Subject Access Request (link to this is in the Bailiff Guide) and then request the return of all of the charges that you have doubtless been overcharged for.

              I just received the following:

              Thank you for your email.

              A bailiff attended your property on May 10th, 2011, this incurred charges of £33.94.

              A bailiff attended your property on May 31st, this incurred charges of £43.44.

              Daniel Simpson attended your property at the above times. He was certified at Burnley Combined Court on 07.09.2011.

              The Van bailiff attended on September 23rd, 2011, and completed a levy. The van attendance was £138.00, the levy fee was £55.60. Ray Meades attended on the 23rd September. He was certified at Burnley Combined Court on 27/04/11

              A correspondence fee of £11.20 has also been added to your account. All fees have been legally added in line with the Enforcement of Road traffic debts regulations, 1993.

                After reading the post above

                am I correct in thinking the charges are legal coz they were for a period of time before the fine was paid

                ie they attended in may the fine was paid in june

                  the fees upto 31st may were paid. I recieved no notice anyone had attended on the 10th. there was a note when I returned home on the 31st demanding £216.30

                  cheque for that was sent by return

                  then the next lot arrives from nowhere

                  and now they are gonna add another £11 for answering the request for charges - although its not the full breakdown I requested.

                  The stress of dealing with this I can do with out and need to focus on my work rather than have this running through my head 24/7. anyone recommend a solicitor that I can pass this all to?

                    Did this levy actually take place and what paperwork did the bailiff leave on this date?

                      no paperwork left regarding any levy. When I spoke to the baliff he did not inform me of any levy

                      on speaking direct to rossendales he informed a levy had been placed on a vehicle parked outside. I wasn't at home, so likely to be my neighbours.

                        Well I would assume that if they have levied a vehicle that is not yours, the levy is invalid. They should have checked with the DVLA to see if the car they allegedly levied on was yours.

                        You could ask them for a copy of the alleged levy to determine which vehicle (if any!) they have levied. It's up to them to prove they made the levy.

                        Or you could just ignore them.

                          I am so sorry Gorang, but Amy has assessed the situation quite accurately and responded appropriately.

                          Should the bailiff require more money from the poor ebgb, one feels he should perhaps be asked to justify his demands in somewhat more detail.

                          One cannot be charged for an offence for which one has already paid the fine.

                            indeedy.

                            but paranoia and a family worrying someone will be banging on the door, let alone the fact that the stress of all this is hindering me getting on with my job etc...

                            I just don't like the ignore them option, at the end of the day I just want them to leave me alone, and it seems to me unlikely they are going to do so (I guess thats probably there preffered modus operandi anyway)


                            might be nothing in the grand scheme of things but, I do feel positively ill stressing about it

                              My dear fellow, complain. Have you also considered perhaps involving your Member of Parliament - nice to see them work for a living. Seriously however, a letter from your elected member could well remove the aforementioned nuisances from your back.
