      Mr Curnow is still a certificated bailiff, though, and he still works for Rossendales.

      From that, might one reasonably conclude that Rossendales condone misrepresentation by bailiffs in their employ?

        That is a very tricky one. You know there is a debt to pay, but we also know there are unfair charges which have been applied to the account.

        If you pay the bailiffs, their fees will be taken out before money is passed on to the council. Technically this is the correct way to do it, but you then have to reclaim the fees retrospectively which is not always straightforward. IF you can pay the council direct (is there any way to pay online or via telephone?) then you can pay the council direct and then pay the bailiff charges once agreed.

        My gut feeling on this is to identify the correct charges, break them down so you know exactly what is for what, then e-mail the CEO of your council, reminding him/her of their vicarious liability. Provide the breakdown of charges which are legitimate and ask for the remainder of the charges to be explained. Ask that until the legitimate charges are agreed, all enforcement action should be placed on hold and to notify their appointed bailiffs accordingly.

        I suspect he will pass it to his Head of Revenues who is quite likely to say the charges are legitimate and you must deal with the bailiffs. If he does, then you go back to the CEO explainng that his Head of Revenues is condoning illegal charges, so you have no choice but to ask him to intervene personally in order to avoid litigation.

        If the Head of Revenues says the charges are wrong, then they really have little choice put to put things on hold until legitimate fees are agreed.
