  • Marstons Distress Warrant

    Hi i awoke this morning to find a piece of paper through my door Notice of Distress.
    Went out to my car and it had been clamped.
    I rang the bailiff and told him to come and remove the clamp as my car was on finance, he said he had checked and said it wasn't, i am still paying it so i know it is.
    He told me i had to pay £1742.74(council tax bill) i said this was impossible and i didn't have the money he said he was coming back.
    When he came back he said he was ordering a tow truck to remove my car .
    I need my car to get to work i called the police who attended and told me he could just take the car.
    I understand it was my fault i got into this mess and spoke to my sister who agreed to help me pay the bill in full however he added £150 because the tow truck had turned up to tow my car i have receipt for the money but am peeved that they have charged me in total £439.31 on top of my original bill can i claim these back now i have paid or am i on a hiding to nothing

    I am sure Amy will be along to give the best possible advice. In the meantime, contact your council and find out exactly how much the Liability Order was for, and write to the bailiffs asking for a breakdown of their fees, including the date and time of the call, the name of the bailiff attending and the court in which they were certified.

    I'd also contact your Chief Constable explaining what happened and formally complaining about whoever attended as they showed great ignorance of the law. Usually the police attend in this situation purely to stop a breach of the peace, but on this occasion if he acutally told you the bailiff was allowed to take a car with outstanding HP, he simply does not know the law. By condoning his act instead of stopping it (through his ignorance of the law) he successfully turned a civil matter into a criminal one.
